Description: A Routine Compliance Inspection was conducted on April 26, 2023, with Vincent Shanberg, Environmental Specialist III, Sara Smith, Environmental Specialist II, and Elsa Portanyi, Environmental Specialist II, with the Florida Department of Environmental Protection, Marathon Office, and Scott Adkins Manager at Walgreens and Chris Bonaventure Consultant with APEX Companies, LLC. The facility has one (1) 1,000-gallon Emergency generator diesel aboveground storage tank. The rupture basin sensor provides release detection. A high-level sensor and alarm provide overfill protection. Certificate of Financial Responsibility was available from January 1, 2023, to December 31, 2023. Monthly inspections were available from January 2021 to December 2021 The following violations/areas of concern were cited: The facility is missing an API color-symbol system on the spill bucket for the tank. Missing visual monthly monitoring documentation for 2022 and 2023. Missing overfill protection annual operability testing documentation for 2021, 2022, and 2023. Missing release detection annual operability testing documentation for 2021, 2022, and 2023. The diesel tank is rusted and corroded. Description: Met Bruce Beckner at the location. This facility has a 1000 gallon Tramont AST servicing an Emergency Generator. Ensure that as part of the Annual testing, the overfill alarm is tested and results maintained. Additionally, as the rupture basin sensor is tested, it is recommended that the 'alarm' be routed to the annunciator panel in the main office and labeled. Placard is present, and release detection records are maintained. Financial responsibility is self insurance. Annual operability testing is performed by Bill First of All Pro Road Service Inc. Description: Met with Jason McCoy, store manager. The outstanding and repeat violation was discussed with him, and Mr. Joseph Rieger via telephone later in the day. As discussed, the Rupture Basin sensor and ATG (Tank Gauging Unit) must be tested Annually and the results maintained for two years. This system was initially Installed without Notice to the Department, and as a result the Department did not have an opportunity to meet the installer onsite to have the Rupture Basin sensor (and overfill alarm) activate and see what horn, alarm, or light would activate, if any. The Rupture Basin sensor must be tested at this time, and it noted what alarm activates and where- inside the genset and/or in the office.

Comments: All federal facilities with USTs will have a placard. Federal facilities with only ASTs will not have a placard. Per FS 376.3077, "It is unlawful for any owner, operator, or supplier to pump or otherwise deposit any motor fuel into a tank required to be registered under section 376.303 FS, unless proof of valid registration is displayed on such tank itself or the dispensing or measuring device connected thereto or, where appropriate, in the office or kiosk of the facility where the tank is located." Penalties can be assessed to the facility owner for failure to properly register tank systems. Note that penalties can be assessed to the supplier that delivers motor fuel to an unregistered facility. Check the details on the placard. Do they agree with the location you are inspecting? Owners of multiple facilities may switch placards by mistake. Placards are not always issued or received in a timely manner at the change of year period (June and July). Provide the DEP Tallahassee phone number to the facility so they may resolve problems (850) 487-7077; (850) 488-3935. Check STCM in the registration/placard section for the date that the payment was made and the date that the placard was issued. The location of the placard in plain view can be subjective in interpretation: a. For vehicular fuel facilities, plain view is meant to allow the transport delivery driver to view the placard prior to delivering fuel. b. A legal definition is an exception to the general requirement of a valid search warrant to legitimize a search or seizure; a search implies prying into hidden places, and it is not a search to observe what is open to view.
