Description: Brief History: On 5/11/2021 a routine TCI was performed at Combs Oil and the facility was cited for having un-repaired components where pumps for PUL and 8B (powertrain fluid) were leaking/dripping and an E-Stop was damaged/not working. Corrective actions were not performed within the 90 day requirement. On 9/15/2021 the facility was referred for enforcement. On 1/1/2025 Palmdale Oil purchased and acquired this facility. On 4/23/2025, the Inspector requested violation resolution without enforcement because corrective actions have been performed since the 5/11/2021 TCI. Records documenting repairs/corrective actions were not available for review since Palmdale Oil purchased the facility and began operations on 1/1/2025. Additionally, loading docks for bulk fueling facilities are not regulated by FDEP 62-762 F.A.C. AST rule requirements. FDEP South District granted the request to resolve the open violation and will close the enforcement referral activity without formal enforcement once this inspection activity is finished. The above noted violation has been resolved within this inspection activity. Photos documenting observed repairs are attached below. AO testing records from 2022, 2023, and 2024 were not available for review pre Palmdale Oil Company purchase. Description: Compliance inspection scheduled/outreach by e-mail on April 26, 2021. No open violation or discharge found at time of inspection. On May 11, 2021, Nereida Hernandez from Collier County met with Mr. Doug Ballard to conduct the Compliance Inspection. The placard, financial responsibility, and facility records were received by email and reviewed prior the inspection. This facility consists of eight (8) registered/regulated in service aboveground storage tanks (ASTs). Tank #1 – 29,800 gallons (double-walled, for vehicular diesel) Tank #2 - 29,800 gallons (double-walled, regular gasoline, E-10) Tank #3 – 29,800 gallons (double-walled, premium gasoline, E-10) Tank #4 – 25,300 gallons (single-walled, regular gasoline, E-10) Tank #5 - 25,300 gallons (single-walled, diesel for highway) Tank #6 - 25,300 gallons (single-walled with two compartments, diesel (empty right now) Tank #7 - 25,300 gallons (single-walled with 5 compartments, new lube oil (supreme EC 15W40 in compartment #7A). Compartments 7B,7C,7D, and 7E are empty. Tank #8 - 25,300 gallons (single-walled with 5 compartments, new lube oil (megaflow AW 68 in compartment #8A and powertran fluid in #8B). Compartments 8C, 8D, and 8E are empty. TANKS: The tanks are located within a concrete secondary containment with four drain valves that were closed at time of the inspection. The valves shall be kept closed except when the operator is in the process of draining (if no product or visible sheen is present). No dripping/leaking issues were observed during the inspection. The tanks are electrically grounded and anchored to a concrete pad. The exterior coating of the tank appears to be in satisfactory condition. No dripping/leaking issues were observed during the inspection. The system is properly labeled per API RP 1637 and NFPA 704. Corrosion to metal components must be minimized by periodic maintenance. SPILL CONTAINMENT – Consists of tight fill connection, and four remote spill containment boxes located on the south side of the concrete secondary containment. Storage tank system equipment shall be maintained in sound operational condition to reduce the likelihood of releases and incidents. OVERFILL PROTECTION – The single-walled tanks (#4 to #8) are equipped with clock gauges with alarm. The double-walled tanks (#1 to #3) are equipped with sensors connected to an OPW Integra 500 with visual and audible alarm. The alarms were tested and found to be functional at time of the inspection. The OPW Integra 500 system is also connected to a computer office. The emergency stop switch located on the northeast side of the tank farm is broken. System components shall be maintained in sound operational condition to reduce the likelihood of releases and incidents. PIPING – Consists of a single-walled bulk piping not in contact with the soil and located within the secondary containment. Except for minor corrosion on the piping (between TK # 5 and #6) and pumps # 7 and #8, the piping was observed in satisfactory condition. Corrosion of metal components must be minimized by periodic maintenance. DISPENSERS/HOSE/NOZZLE – The system is equipped with remote dispensers/pumps on the north and east side of the concrete secondary containment. Except for a minor dripping at the premium and “powertran” pumps, the hoses/nozzles appear to be in satisfactory condition. System components shall be maintained in sound operational condition to reduce the likelihood of releases and incidents. RELEASE DETECTION: The facility conducts monthly visual inspections of visible/exposed tank components including tank coating, secondary containment, spill containments, hose, and nozzle. The system is located within a concrete secondary containment that provides for overfill and release protection to the single-walled tanks (TKs #4 to #8). The secondary containment was observed in satisfactory condition at time of inspection. Double tanks (TKs #1 to #3) are visually inspected by opening the drain valve. The drain valves were opened, and condensate water was observed in TK#3. DOCUMENTS REVIEW: PLACARD: The Placard expiration date is June 30, 2021 Storage tank registration fees are due to the Department each year by July 1. Ensure that your contact information is up to date with the Department in order to receive updates concerning your annual registration fees. Once fees are paid, you must print a copy of your placard from the Department's website: http://www.fldepportal.com/go/submit-registration/. FINANCIAL RESPONSIBILITY: The facility is insured by Allied World Surplus Line. The most recent coverage period is from February 15, 2021 to February 15, 2022 (Parts D & P available for review). Financial Responsibility must be maintained until your ASTs have been properly closed and your Closure Report/Limited Closure Report Form has been submitted to and approved by the Department. Records must be kept for three years. MONTHLY VISUAL INSPECTION REPORT: Monthly visual inspections of visible/exposed tank components are conducted within the allotted 35 days. Period reviewed: January 6, 2020 to May 4, 2021 (last visual inspection). ANNUAL OPERABILITY TEST/ OVERFILL AND RELEASE DETECTION: Not required for release detection. The single-walled tanks and components are located within a concrete secondary that provides for overfill and release detection and the double-walled tanks are visually inspected (drain valve). “The secondary containment shall be: “impervious to the regulated substances being stored in the storage tank system and able to withstand deterioration from external environmental conditions”. Overfill devices (clock gauges with alarm and OPW sensors and alarm) were tested by Discovery Tank Testing on February 17, 2021. Next due date is February 17, 2022. GENERAL REMINDERS: Incident investigations must be initiated within 24 hours. If within 72 hours of discovery the investigation does not confirm that a discharge did not occur, then the incident must be reported to the contracted county. All positive responses of release detection devices (such as alarms) must be investigated and a determination made as to whether a discharge occurred. Records of all incidents must be maintained along with the incident investigation findings for inspection by the Department or contracted county. Repairs, Operation and Maintenance: Storage tank system equipment shall be maintained in sound operational condition to reduce the likelihood of releases and incidents. Corrosion of metal components must be minimized by periodic maintenance. Records generated on or after January 11, 2017, shall be kept for three years. Records generated before January 11, 2017, are required to be kept for two years, in accordance with rule 62-762.711, F.A.C. Due to the COVID 19 pandemic, the facility representative was not required to sign the report. Description: - The facility was built over 15 years ago, but there were disputes with the fire marshal having jurisdiction and the inspections were never performed to CO the property - The County bought easement from Mr. Combs at his old facility and part of the deal would be that the County CO the property off Industrial Blvd at the new facility and the plans were re-submitted to the building department - See inspection checklist for more details concerning the inspection 2019 General Reminders for Regulated AST Owners/Operators Registration Fees - Placard Storage tank registration fees are due to the Department each year by July 1. Ensure that your contact information is up-to-date with the Department in order to receive updates concerning your annual registration fees. Once fees are paid, you must print a copy of your placard from the Department's ESSA Online Business Portal. In general, you are not legally allowed to receive motor fuel without a valid placard on display at your facility. Financial Responsibility If your ASTs store petroleum or petroleum products, you are required to demonstrate and maintain financial responsibility (FR), such as insurance, for pollution liability. FR must be maintained until your ASTs have been properly closed and your Closure Report/Limited Closure Report Form has been submitted to and approved by the Department. Please note: Financial Responsibility is required for out-of-service ASTs Release Detection - Visual Inspections You are required to visually inspect your storage tank system components every month (not to exceed every 35 days) and document your findings. Your findings must be maintained for 3 years and made available for inspection by the Department or contracted county. A monthly visual inspection is not required for any component that uses an electronic release detection method; however, piping and dispenser sumps that use electronic devices must also be visually inspected every 6 months and records kept for 3 years. Release Detection - Electronic Devices Electronic release detection devices shall be inspected for proper operation every month (not to exceed every 35 days). A record or summary of the alarm history, sensor status and testing results shall be printed from the device and kept for 3 years. If the device does not have print capability, then a manual log must be maintained. Release Detection - Line Leak Detectors & Valves Line leak detectors are required for storage tank systems with pressurized small diameter piping in contact with the soil. Isolation block valves are required for all ASTs. Anti-siphon valves are required in instances where the tank places a gravity head on the small diameter piping (the piping is below the product level in the tank). Annual Operability Testing - Release Detection Devices & Overfill Protection Equipment All release detection devices must be tested for operability annually at intervals not exceeding 12 months to ensure proper operation and be registered with the Department. Effective October 17, 2019, owners and operators must designate a primary overfill device. Secondary overfill devices cannot interfere with the proper operation of the designated primary device. The designated primary overfill device must be registered with the Department and perform annual operability testing at intervals not exceeding 12 months. Periodic Integrity Testing Periodic testing of storage tank system components in contact with the soil shall occur according to the following schedule: a. Piping sumps, dispenser sumps, hydrant sumps, and below-grade spill containment systems - every 3 years not to exceed 36 months; b. Piping and dispenser sumps over surface waters of the state shall be tested within one year of July 9, 2019, and every three years thereafter, not to exceed 36 months. Incident Response An incident is a condition or situation indicating that a release or discharge may have occurred. Incident investigations must be initiated within 24 hours. If within 72 hours of discovery the investigation does not confirm that a discharge did not occur, then the incident must be reported to the contracted county. All positive responses of release detection devices (such as alarms) must be investigated and a determination made as to whether a discharge occurred. Records of all incidents must be maintained along with the incident investigation findings for inspection by the Department or contracted county. Repairs, Operation and Maintenance Storage tank system equipment shall be maintained in sound operational condition to reduce the likelihood of releases and incidents. Corrosion of metal components must be minimized by periodic maintenance. Water in excess of one inch in depth or any regulated substances collected in secondary containment shall be removed within 72 hours of discovery and properly disposed. Closure Integrity Evaluations A closure integrity evaluation must be conducted no more than 45 days prior to closure of double-walled ASTs, double-bottomed field erected ASTS, double-walled integral piping, piping sumps, dispenser sumps, hydrant sumps, and spill containment systems that are in contact with the soil to determine whether closure sampling is required. If required, closure sampling must be conducted in accordance with Instructions for Conducting Sampling During Aboveground Storage Tank Closure, July 2019. For all closures, a Closure Report or Limited Closure Report, dependent on the situation, must be submitted to the contracted county within 60 days.
