Closure Requirements: A Closure Assessment Report for the Premium Double-Walled Spill Containment will be due to this office within 60 days of closure activities. Closure Assessment Report is due before March 21, 2025. Equipment Installed Spill Containment: (EQ-741) Emco Wheaton Retail Corporation, Emco Wheaton Secondary Spill Containment Models A1004 UL File no. MH21149. Overfill Prevention: (EQ-414) Emco Wheaton Retail Corporation, Guardian Dual Point Overfill Prevention Valve. The Double Wall Premium Spill Containment was installed, and vacuum tested by Guardian Fueling Technologies and passed. The interstitial gauge was also tested and passed (see attachments for a copy of the test results). The Premium Overfill Prevention Device was installed, and tested by Guardian Fueling Technologies and passed (see attachments for a copy of the test results). The testing was completed, and the results were reviewed by our office prior to the facility bringing the system back into service. The new double wall premium spill containment and overfill prevention device appears to have been installed per manufacturer's instructions. No violations issued at the time of inspection. Facility currently has an ongoing enforcement case. Please contact the enforcement case manager regarding questions about the enforcement case.

Description: Met onsite with Jason Meade (7G Environmental Compliance Technician) for this routine tank compliance inspection. A copy of this inspection report and compliance assistance offer letter will be emailed to Scott Janashak at sjanasha@circlek.com, Mike Sawkiewicz at msawkiew@circlek.com, Ira Lewis at ilewis@circlek.com, and gc-ess@circlek.com. Tanks: Both tanks are Modern Welding Company of Florida, Inc. Glassteel II Underground Storage Tanks. Tank #4 is 15,000 gallons containing Regular Unleaded. Tank #5 is 10,000 gallons with two compartments containing 5,000 gallons Premium Unleaded and 5,000 gallons Vehicular Diesel. Both tanks were installed May 2019. Piping: NOV Fiberglass, Red Thread IIA primary/secondary piping (EQ-252) with Franklin Fueling Systems, Mechanical Line Leak Detectors (EQ-335). Dispensers: Dispensers: Franklin Fueling Systems, Dispenser Sumps (EQ-612). The dispenser sumps were mostly clean and dry at the time of inspection. The boots, hoses, and nozzles appeared to be in good condition. The sensors were in the correct position. Dispenser 3/4 and 5/6 Regular Shear Valve bolt is missing -Violation Issued. STP Sumps: Dispensers: Franklin Fueling Systems, UST Sumps (EQ-612). The Premium and Diesel STP Sumps and Regular Piping Sump contained excessive amount of liquid at the time of inspection -Violation Issued. The Regular STP Sump Sensor was in the incorrect position -Violation Issued. The Premium STP Sump Pump and Components are corroded/rusted -Violation Issued. The junction box in the Regular STP Sump is damaged -Violation Issued. The Regular and Premium STP Sumps appear to be damaged -Violation Issued. Spill Containments: Franklin Fueling Systems, double-walled spill containment with interstitial integrity gauges (EQ-757). All the spill containments contained liquid, but the liquid was removed at the time of inspection by the 7G Compliance Technician. Annual Operability of the Spill Containment Gauges were unavailable for review -Violation Issued. Integrity Testing of the Spill Containments were unavailable for review -Violation Issued. The Premium Spill Containment is bulging -Violation Issued. The Regular Spill Containment Gauge indicates liquid in the interstitial space -Violation Issued. Overfill Prevention: Franklin Fueling Systems, Overfill Prevention Valves (EQ-838-R). The Premium Overfill Device failed operability testing on 07/10/2024 -Violation Issued. Release Detection: The tanks interstitial sensors, STP sump sensors, and dispenser sump sensors are being monitored by a Veeder-Root TLS 350 Automatic Tank Gauge (EQ-033). Monthly visual inspection of all tanks related equipment is being conducted by 7G Environmental Compliance Management. The Premium and Diesel STP Sump Sensors (L5 and L6) were in fuel alarm at the time of inspection. All other sensors were normal. Annual Operability of the ATG System was unavailable for review -Violation Issued. The Regular Piping Sump Sensor (L4) was not sensing the liquid in the sump -Violation Issued. Records: Most of the facility records were received, some associated tank component testing, monthly visual inspection with electronic release detection ATG printouts, and financial responsibility forms and the current placard was posted at the facility. Tank #4 is 15,000 gal containing Regular Unleaded. Tank #5 is 10,000 gal that has 2 compartments: Premium and Diesel. Both tanks were installed in May 2019. Both Tanks are registered as Aboveground Storage Tanks (AST) -Violation Issued. PIPING: Fiber Glass Systems, Red Thread (EQ-252) with mechanical line leak detectors (Franklin Fueling Systems, MLD EQ-335). The Line Leak Detectors were tested by Valley on 06/27/22 and passed. SPILL CONTAINMENT: Franklin Fueling Systems Defender series, Double Wall buckets with interstitial gauges. Regular Unleaded Vapor Recovery Bucket contained PCW - Violation Issued. Premium Spill Bucket and Vapor Recovery Bucket contained PCW - Violation Issued. Premium Spill Bucket Interstitial Gauges showed liquid in the interstice at the time of inspection - Violation Issued. DISPENSERS: OPW Pisces (EQ-368). All dispenser hoses and nozzles appeared to be in good condition. Dispenser 3/4 and 5/6 Test Boots appear to be capped -Violation Issued. Dispenser 7/8 piping appears to be weeping -Violation Issued. STP SUMPS: Franklin Fueling Systems, Phil-Tite UST Sump (EQ-612). All STP Sumps contained PCW -Violation Issued. The Sensor in the Regular Unleaded, Diesel, and Premium STP Sumps need to be lowered no more than 1” from the bottom of the sumps -Area of Concern. OVERFILL PREVENTION: Franklin Fueling Systems, defender series OPV(EQ-838). Annual operability of overfill device is current till 06/27/23. Overfill Alarm did not sound at the time of inspection -Violation Issued. RELEASE DETECTION: This tank has Tank IM sensors, STP sump sensors and Dispenser sump sensors that are monitored by a Veeder Root TLS Automatic Tank Gauge (ATG) TLS 350 (EQ-724). Monthly visual inspections of all tanks related equipment are conducted by 7G Environmental Compliance Management. Sensor status reports are printed monthly. All functions normal on ATG at time of inspection however the Regular STP Sump Sensor is not sensing the PCW in the sump -Violation Issued.

This facility has consistently had severe flooding problems and the sumps/containments should be checked for watertightness. Subject: On March 16, 2011, we met with Heather Gilmore, Regional Environmental Manager for Circle K, Stores, Inc. The meeting¿s purpose was to discuss compliance issues at 16 Escambia Circle K Stores facilities. The meeting was held at the request of the District. The meeting request was offered in a letter, issued on February 24, 2011, which names the specific compliance problems at the 16 Escambia County facilities. The letter is attached. Mr. Harp expressed the concerns described in the said letter. He explained that a history of the same violation at the same facility suggests a pattern of poor tank management. He mentioned that the violations cited are subject to Department enforcement action including civil penalties, particularly when they occur routinely and are not corrected promptly. Ms. Gilmore explained that work was being done to correct some of the problems related to the electronic release detection systems. She did not propose any resolution to the problem of sump maintenance and the removal of collected water. Messrs. Harp and Hollingshead suggested that sumps be inspected on a monthly basis (as required by the rule), and that any discovered water be pumped out and disposed of properly. She stated that she would take action to prevent these violations from recurring. A plunger in Dispenser 3/4 was easily depressed and petroleum contact water emerged (see photo) - violation issued. The Veeder-Root TLS-350 displays numerous alarms that should be corrected injcluding a Sensor Out Alarm for Regular Unleaded STP Sump.. This is the second tank at this site with an intersticial alarm due to water in the tank's interstice. All three tanks at this facility have had the Parabeam installation to meet the double-walled tank requirements. Heather asked for any recommendations from our department but I could only suggest having a PSSC Contractor evaluate the problem.
