Hello Ms. Jones,
I represent the Florida Department of Environmental Protection (DEP) in the petroleum storage tank division. Our office is contracted by the DEP to inspect commercial fuel storage tanks in Central Florida (five counties). It has been brought to my attention that the property has changed ownership. Per the requirements of Florida Administrative Code Chapter 62-762.401(3)(a):
(3) A completed Registration Form shall be submitted to the Department in paper or electronic format within 10 days of the following changes or discovery:
(a) Any change in the owner or operator of a facility or of a storage tank system;
Please see and complete the attached DEP Storage Tank Registration Form to update the C. REAL PROPERTY OWNER INFORMATION on the form.
Also, before the 1,000-gal fuel tank is removed from the facility, our office is required to be notified via email 30-45 days and 48-72 hours prior to the removal of the tank. Our office is required to perform a tank closure inspection for the DEP.

Good Morning Troy,
Tupperware Corp will be referred for enforcement on 04/11/19. Please provide the following documentation to resolve open violations:
1. Annual operability test results for the interstitial gauge on tank 7.
a. Thereafter, testing shall be performed annually not exceeding 12 months.
2. Install FDEP approved fuel level gauges on tanks 5, 6, & 7.
a. OEM Econo Gauges (model 14495) on tanks 5 & 7 are approved.
b. The approved Krueger fuel level gauge on tank 6 looks faded/damaged (should be replaced).
c. Provide a work order describing the replacement of these components.
i. An approved equipment list is attached.
3. Annual operability test results for overfill protection devices on tanks 5, 6 & 7.
a. Newly installed fuel level gauges on tanks 5, 6 & 7 must be calibrated to 90%.
b. Verify if the fuel alarm on tank 6 is the high or low level type.
c. Thereafter, testing shall be performed annually not exceeding 12 months.
i. A test form is attached also.
4. Current financial responsibility documents (insurance expired 02/15/2019).
a. A Certificate of Financial Responsibility (CFR) must be completed by Tupperware Corp.
b. A Certificate of Insurance (COI) must be completed by the insurance company.
c. A signed insurance policy must be attached to the CFR & COI.
d. A list of insured facilities must be attached to the CFR & COI.
i. The financial references & requirements form describes this requirement.
ii. The required forms are attached as well.
5. A fuel type label was not observed on tank 6.
a. Place a diesel label/decal on tank 6.
b. Provide pictures showing the tank is properly labeled.
6. Correct monitoring registration information for tank 5.
a. Monitoring registration information was updated incorrectly to “not required.”
b. Monitoring registration information should be corrected to “DEP approved monitoring.”
i. Tank interstitials are monitored visually/externally with a tank gauging stick.
If you wish to perform annual operability testing “in house”, complete the attached test forms for each individual FDEP approved overfill protection and/or release detection device.
Attach manufacturer specifications to test forms. Provide a formal letter describing testing procedures for these components in accordance with PEI RP1200 & FAC 62-762.
If you are uncomfortable with testing devices, it is highly recommended to hire a tester/contractor. Once documentation is received before 04/11/19, a return to compliance letter will be issued.
Failure to provide this documentation before 04/11/19 will result in enforcement by the Florida Department of Environmental Protection (FDEP). If you have any questions, please feel free to contact me.

Hi Troy,
Thank you very much for the fuel gauge pictures. I resolved both testing violations. It appears that the interstitial gauge for tank 7 should be changed soon. As of now, there two open violations:
1. Some financial responsibility documents are missing.
a. CFR form needs to be filled out by Tupperware.
b. Indian Harbor Insurance policy needs to be submitted.
2. Pictures of new fuel type labels on tank 6 are missing.
a. Fuel type labels should be added on tank wall/fill box.

Good Afternoon Troy,
I will resolve the monitoring registration and interstitial gauge testing violations. However, the following open violations need to be resolved:
1. Some financial responsibility documents are MISSING (02/15/19-02/15/22).
a. A Certificate of Financial Responsibility (CFR) must be completed by Tupperware Corp.
b. A signed insurance policy from Indian Harbor Insurance must be provided.
i. A list of insured facilities must be included.
ii. This is required to demonstrate that data on forms correlates with the policy.
iii. The required form is attached as well.
2. Fuel type labels NOT observed on tank 6.
a. The submitted pictures show fire code labels on the tank walls.
b. This satisfies some NFPA requirements, NOT FDEP requirements.
c. Place diesel labels on the tank and spill bucket.
3. Installation documents & pictures of FDEP approved fuel level gauges on tanks 5, 6, & 7 NOT recieved.
