Mrs. Pedigo advised Ms. McCall of the steps that would have to be taken to convert the tanks to water tanks. On April 2, 2017, Steve Jarrett e-mailed Ms. McCall advising that the county office never received a response as to whether they had converted their USTs to water tanks as required per Mrs. Pedigo’s instructions. - Steve also stated that on January 11, 2017, the Underground Storage Tank System rule (Chapter 62-761, Florida Administrative Code) had been revised. Description: Note: Chapter 62-761 Florida Administrative Code (F.A.C.), Underground Storage Tank Systems, has been revised and published with effective dates of 01/11/2017, 07/09/2019, 10/13/2019, and 06/25/2023. - The revised rule and forms can be viewed at the Florida Department of Environmental Protection’s (FDEP) Storage Tank Compliance web site under rules and related laws: https://floridadep.gov/waste/permitting-compliance-assistance/content/storage-tank-system-rules-forms-and-reference. Per Department files, the facility was heavily damaged by the hurricanes that occurred in 2004 and subsequently, the facility was closed. - The storage tank systems were placed out of service on June 1, 2006. - Per 62.761.800(1)(e), Florida Administrative Code (F.A.C.), systems with secondary containment installed and operated in accordance with this Chapter may remain in a continuous out-of-service status for ten years. - After this period, the system(s) shall be returned to service or closed in accordance with subsection 62-761.800(2), F.A.C. - Therefore, the storage tanks systems at this site were to be placed back into service or permanently closed by June 1, 2016. Per file record: On May 24, 2016, Mrs. Leslie Pedigo, Florida Department of Environmental Protection (FDEP) – Southwest District, e-mailed Ms. Sylvia McCall advising the storage tank systems had to be permanently closed by June 1, 2016 as the ten-year period will expire on that date. On July 14, 2016, Mrs. Pedigo again e-mailed Ms. McCall advising the storage tanks must be permanently closed. Note: At the time of the 05/17/2024 inspection, no buildings were present, the concrete dispenser island appears to be present but the dispensers have been previously removed with the liners filled with concrete, per file record. A cracked concrete pad with weeds appears to be present above the two USTs (see photos). The facility is gated and fenced and no access was provided. Per Department files, the following release detection methods were performed when the facility was open: Release Detection: - Tanks: Vacuum monitoring of tank interstices; - Piping: Visual monitoring of piping interstices; - Visual inspections of tank interstices (via vacuum gauges), dispensing systems (liners, nozzles, and hoses), and single-walled, spill containment buckets. Tanks/Piping: Per Department files: (2) 2,000-gallon, PermaTank, double-walled, fiberglass-jacketed, steel USTs with double-walled, fiberglass, underground (suction) piping. - No part of the system was inspected as access was not provided to the facility/site. - Unable to determine if tanks are properly out-of-service. - At the time of the last Routine Compliance Inspection on 05/20/2021, it was determined that each tank contained the following amounts of water and fuel: - Westernmost UST contained 1 ½” of water and 7” of product; - Easternmost UST contained 8 ½” of water and 3” of product; - No response was received after the last inspection report and Compliance Assistance Offer Letter were issued. Description: Note: At the time of the inspection, no buildings were present, the concrete dispenser island remains but the dispensers have been previously removed with the liners filled with concrete, and a cracked concrete pad with weeds remains above the two USTs (see photos). The facility is gated and fenced and used as part of an area for cattle grazing (pasture surrounds the former facility). Discussions were held with Ms. McCall regarding the cleaning of the tanks to convert them to hold water and therefore, closing them as regulated storage tank systems. - I advised Ms. McCall I could e-mail her a list of companies that pump out the remaining fuel in USTs and then properly clean them for closure. - I stated the Department cannot recommend a company and the list only contained companies that had performed these services in Polk and Hardee Counties and that other companies could be found by performing a search on the internet. In regards to performing either the required Closure Integrity Evaluation or a Closure Assessment of the USTs and associated system components per 62-761.800(2), F.A.C., discussions will need to be held with representatives from FDEP-Southwest District (SWD) to determine which course of action must be followed due to the unique circumstances at this facility: - Systems placed out of service longer than the allowed ten-year period; - Vacuums not maintained on the tank interstices as required; - Dispenser liners closed in place by filling them with cement without the Department being present to confirm the liners were clean and free of product residue, that the product lines had been blown back to the tanks to ensure no product residue remained in the lines, and the product lines were capped prior to the cementing of the liners, and; - Due to product still present in the tanks. Per Department files, the following release detection methods were performed when the facility was open: Release Detection: - Tanks: Vacuum monitoring of tank interstices; - Piping: Visual monitoring of piping interstices; - Visual inspections of tank interstices (via vacuum gauges), dispensing systems (liners, nozzles, and hoses), and single-walled, spill containment buckets; Tanks/Piping: Per Department files: (2) 2,000-gallon, Perma Tank, double-walled, fiberglass-clad, steel USTs with double-walled, fiberglass, underground piping present. Tanks are equipped with: - No piping sumps or piping street boxes were observed on site; per Department files, this was a suction system; - (2) Street boxes (see photos), each containing or formerly containing the vacuum gauges to monitor the tank interstices; however, per Department files, the vacuum has not been maintained on the tanks for years with the gauge for the easternmost UST missing. - Therefore, as each street box lid were mostly buried under dirt and debris and as per a conversation with Ms. McCall, new gauges have not been installed with the vacuum reset on the tanks, the lids were not removed for inspection. - (2) Single-walled, EBW spill containment buckets (see photos); - Each spill bucket was full of water and “settled” mud; therefore, I could not check the integrity of the buckets. - However, as the systems must be permanently closed, the water and mud do not need to be removed at this time. - Enough water was removed to open the fill caps to check the fluid level of each tank; - Using fuel and water finding pastes, it was determined that each tank contained the following amounts of water and fuel: - Westernmost UST contained 1 ½” of water and 7” of product; - Easternmost UST contained 8 ½” of water and 3” of product; - Fill covers were not marked per API RP 1637; however, as the systems must be permanently closed, they do not have to be marked at this time. - (2) Vent lines with caps present (see photos); Dispensers (previously removed): - (2) Dispenser liners; - The metal liners (per Department files) have been filled with concrete above the top of the liner (see photos); - It is unknown whether the liners were clean and free of product residue with the product lines capped prior to the cementing the liners; Records: - 2020/2021 fiscal year storage tank registration placard was not available; however, per a review of the FDEP database, the fees were paid, and the placard was issued on 06/23/2020 – 2 tanks (placard #586754); - The facility contact, and account owner information appears to be correct per Ms. McCall; however, the property owner information has not been registered with FDEP as required. - Therefore, the property owner information must be registered with FDEP by either completing and submitting the attached FDEP storage tank registration form or by completing the required updates on the FDEP “ESSA” storage tank registration web site: https://floridadep.gov/waste/permitting-compliance-assistance/content/storage-tank-facility-registration. - Financial Responsibility: not available, per discussions with Ms. McCall, she is unable to obtain pollution liability insurance coverage; - However, per 62-761.800(2)(a)3, F.A.C., storage tanks systems where financial responsibility is not maintained and demonstrated, must be closed within 90 days of the termination of the financial mechanism. - Certification of Financial Responsibility Form - not available; - Monthly release detection monitoring records reviewed: per discussions with Ms. McCall, she has not performed any annual release detection inspections. - Annual tank system testing is not required as the tanks had been placed out of service; - Operator Training Certifications - The Class A/B/C Operator training certifications are not required as the tanks are out of service. - Per 40 CFR 280 Subpart J, United States Environmental Protection Agency (USEPA), all UST owners are to have designated and trained operators (Class A, B, & C) by October 13, 2018. Description: Note: Per Department files, the facility was heavily damaged by the hurricanes that occurred in 2004 and subsequently, the facility was closed. - The storage tank systems were placed out of service on June 1, 2006. - Per 62.761.800(1)(e), Florida Administrative Code (F.A.C.), systems with secondary containment installed and operated in accordance with this Chapter may remain in a continuous out-of-service status for ten years. - After this period, the system(s) shall be returned to service or closed in accordance with subsection 62-761.800(2), F.A.C. - Therefore, the storage tanks systems at this site were to be placed back into service or permanently closed by June 1, 2016. On May 24, 2016, Mrs. Leslie Pedigo, Florida Department of Environmental Protection (FDEP) – Southwest District, e-mailed Ms. Sylvia McCall advising the storage tank systems had to be permanently closed by June 1, 2016 as the ten-year period will expire on that date. On July 14, 2016, Mrs. Pedigo again e-mailed Ms. McCall advising the storage tanks must be permanently closed. Per a conversation with Mrs. Pedigo, Ms. McCall provided a response to Mrs. Pedigo stating they wanted to convert the two tanks to water tanks. Mrs. Pedigo advised Ms. McCall of the steps that would have to be taken to convert the tanks to water tanks. On April 2, 2017, I e-mailed Ms. McCall advising that my office never received a response as to whether they had converted their USTs to water tanks as required per Mrs. Pedigo’s instructions. - I also stated that on January 11, 2017, the Underground Storage Tank System rule (Chapter 62-761, Florida Administrative Code) had been revised. Part of the revised rule stated that any UST system that did not have proof of financial responsibility had to be permanently closed within 90 days. - Therefore, I advised Ms. McCall, that the 90 days to permanently close the tanks would expire on April 11, 2017. I requested she provide an update on whether they were still going to convert their USTs to water tanks or permanently close them On April 18, 2017, I received an e-mail from Ms. Sylvia McCall stating they had contacted a closure company and are having discussions about converting the tanks to cisterns. She stated she would keep the Department apprised of their actions going forward. On March 20, 2019, I received an e-mail from Ms. McCall that contained manifests for the removal of product and water in the tanks on 06/02/2006 by A&S Oil Recover of Florida, Inc.; and a copy of a Site Rehabilitation Completion Order from DEP dated 08/15/2008 for a 03/14/1991 discharge. - The e-mail also contained a groundwater flow direction map dated 05/05/2006, a photograph of the USTs prior to their original installation and a photograph of a former remediation unit on site. Note: At the time of the inspection, no buildings were present, the concrete dispenser island remains but the dispensers have been previously removed and a cracked concrete pad with weeds remains above the two USTs (see photos). The facility is gated and fenced and used as part of an area for cattle grazing (pasture surrounds the former facility). Per my conversation with Ms. McCall while on site, she stated they had previously foamed the spill bucket lids and manways to prevent outside access to the storage tanks. - Therefore, no attempts were made to access the tank interstices or spill buckets during the inspection. Per Department files, the following release detection was performed when the facility was open: Release Detection: - Tanks: Vacuum monitoring of tank interstice; - Piping: Visual monitoring of piping interstice; - Visual inspections of tank interstice, sumps, dispensers/liners and spill containment buckets; Tanks/Piping Sump/Piping: Per Department files: (2) 2,000-gallon, Perma Tank, double-walled, fiberglass-clad, steel USTs with double-walled, fiberglass, underground piping is present. Description: Note: Per Department files, the facility was heavily damaged by the hurricanes that occurred in 2004 and subsequently, the facility was closed. - The storage tank systems were placed out of service on June 1, 2006. Per 62.761.800(1)(a)3, Florida Administrative Code (F.A.C.), systems with secondary containment installed and operated in accordance with this Chapter may remain in a continuous out-of-service status for ten years. After this period, the system(s) shall be returned to service or closed in accordance with subsection 62-761.800(2), F.A.C. Therefore, the storage tanks systems at this site were to be placed back into service or permanently closed by June 1, 2016. On May 24, 2016, Mrs. Leslie Pedigo, Florida Department of Environmental Protection (FDEP) – Southwest District, e-mailed Mrs. Sylvia Fuller advising the storage tank systems had to be permanently closed by June 1, 2016 as the ten year period will expire on that date. On July 14, 2016, Mrs. Pedigo again e-mailed Mrs. Fuller advising the storage tanks must be permanently closed. Per a conversation with Mrs. Pedigo, Mrs. Fuller provided a response to Mrs. Pedigo stating they wanted to convert the two tanks to water tanks. Mrs. Pedigo advised Mrs. Fuller of the steps that would have to be taken to convert the tanks to water tanks. On April 2, 2017, I e-mailed Mrs. Fuller advising that my office never received a response as to whether they had converted their USTs to water tanks as required per Mrs. Pedigo’s instructions. - I also stated that on January 11, 2017, the Underground Storage Tank System rule (Chapter 62-761, Florida Administrative Code) had been revised. Part of the revised rule stated that any UST system that did not have proof of financial responsibility had to be permanently closed within 90 days. - Therefore, I advised Mrs. Fuller, that the 90 days to permanently close the tanks would expire on April 11, 2017. I requested she provide an update on whether they were still going to convert their USTs to water tanks or permanently close them On April 18, 2017, I received an e-mail form Mrs. Sylvia McCall stating they had contacted a closure company and are having discussions about converting the tanks to cisterns. She stated she would keep the Department apprised of their actions going forward.

Description: Note: I had sent an e-mail to Mrs. Sylvia McCall on April 21, 2017 requesting to perform the routine compliance inspection on either April 24th or 25th. However, I never received a response; therefore, on April 26th, after I had completed an inspection at a nearby facility, I went to this location to perform the routine compliance inspection. At the time of the inspection, no buildings were present, the concrete dispenser island remains but the dispensers have been previously removed and a cracked concrete pad with weeds remains above the two USTs (see photos). The facility is gated and fenced and used as part of an area for cattle grazing (pasture surrounds the former facility). Per Department files, the following release detection was performed when the facility was open: Release Detection: - Tanks: Vacuum monitoring of tank interstice; - Piping: Visual monitoring of piping interstice; - Visual inspections of tank interstice, sumps, dispensers/liners and spill containment buckets; However, at the time of the inspection, the vacuum gauge for the easternmost tank appears to be missing with wires running down into the interstitial port and a glass jar that formerly covered the port was off to the side (see photo). The gauge for the western tank was clouded over; therefore, the gauge could not be read (see photo). Therefore, it does not appear a vacuum is being maintained on the tank interstices. However, the equipment present prevented the interstices from being manually checked. Tanks/Piping Sump/Piping: Per Department files: (2) 2,000-gallon, Perma Tank, double-walled, fiberglass-clad, steel USTs with double-walled, fiberglass, underground piping is present. Tanks are equipped with: - No piping sumps or street boxes were observed on site; per Department files, this was a suction system; - (2) Street boxes were inspected, each containing or formerly containing the vacuum gauges to monitor the tank interstices (see previous comments) - (2) Single-walled, EBW spill containment buckets; - The western spill bucket had a foam-like material around the edge of the spill bucket lid that made removing the lid difficult. The foam-like material was partially under the edge of the opened lid as well (see photo) - The bucket was full of water up to the middle of the cap (see photo); therefore, the fill cap could not be removed to measure the content of the UST. - The eastern fill cap was partially covered by the same foam-like material which prevented the opening of the lid (see photo). - The fill cap for the western fill appeared unsecure as a lock was not present on the fill cap; locks must be installed on the fill caps to secure the storage tank systems. - (2) Fill covers were not marked per API RP 1637; however, as the systems must be permanently closed, they do not have to be marked at this time. - (2) Vent lines with caps present (see photos); Dispensers (previously removed): - (2) Dispenser liners; - The metal liners have been filled with concrete above the top of the liner (see photo); - It is unknown whether the product lines were capped prior to cementing the liners; Records: - Current Registration Placard not available; per a review of the FDEP Storage Tank Registration database, the current registration fees have not been paid. - The current fiscal year (2016/2017) registration fees must be paid with a copy of the registration placard forwarded to the Department. - Financial Responsibility: not available, per previous conversations with Mrs. McCall, she is unable to obtain pollution liability insurance coverage; - Certification of Financial Responsibility Form - not available; - Monthly release detection monitoring records reviewed: per previous conversations with Mrs. McCall, she has not performed any release detection inspections. - Annual tank system testing was not required as the tanks had been placed out of service; - Operator Training Certifications - The Class A/B/C Operator training certifications were not available for review. Description: Note: Per a conversation with Mrs. Sylvia Fuller on April 28, 2015, she provided permission to enter the gated (locked) and fenced site to perform the routine compliance inspection. Mrs. Fuller advised me to contact Mr. Perry Mushrush to schedule the date and time of the inspection so that he could unlock the gate. Mr. Mushrush was contacted the same day and he agreed to have the gate unlocked for the inspection at 9:30 am, Monday, Mary 4, 2015. - Mr. Mushrush arrived on site as I was finishing the inspection. Note: Per Department files, the facility was damaged by the 2004 hurricanes and subsequently, closed. At the time of the inspection, no buildings are present, the concrete dispenser island remains but the dispensers have been removed and a cracked concrete pad with weeds remains above the two USTs (see photos). The facility is gated and fenced and used as part of an area for cattle grazing (pasture surrounds the former facility). Note: The storage tank systems were placed out of service on June 1, 2006. Per 62.761.800(1)(a)3, Florida Administrative Code (F.A.C.), systems with secondary containment installed and operated in accordance with this Chapter may remain in a continuous out-of-service status for ten years. After this period, the system(s) shall be returned to service or closed in accordance with subsection 62-761.800(2), F.A.C. Therefore, the storage tanks systems at this site must either be placed back into service or permanently closed by June 1, 2016. Per Department files, the following release detection was performed when the facility was open: Release Detection: - Tanks: Vacuum monitoring of tank interstice; - Piping: Visual monitoring of piping interstice; - Visual inspections of tank interstice, sumps, dispensers/liners and spill containment buckets; However, at the time of the inspection, the vacuum gauge for the easternmost tank appears to be missing with wires running down into the interstitial port and a glass jar covering the port (see photo). The gauge for the western tank was clouded over; therefore, the gauge could not be read (see photo). Therefore, it does not appear a vacuum is being maintained on the tank interstices. However, the equipment present prevented the interstices from being manually checked.

Description: Facility Annual Compliance Inspection performed on 3/9/10 by Jodie Bell. Site leasee Perry Mushrush (862-781-1862) was there to unlock the gate. Facility has 2 D/W fiberglass clad steel USTs that have been out-of-service since 6/1/06. Method of release detection for D/W USTs and D/W piping was monthly monitoring of vacuum gauges and visual monitoring of all other components. Records: Reviewed registration information in the DEP database (no placard) and was current; no insurance policy which is OK at this time. No visual inspection documents were provided for 6 month inspections as required (cited above). Physical inspection: The two spill buckets were full of water and the fill caps were not locked. Water had to be removed from spill buckets before inspector could stick tanks. Inspector stuck 2 tanks. Premium tank (west) had less than 1" water but regular tank (east) had 5 & 1/4" water. Water is getting into the tank. To render a tank out-of-service, a tank must contain less than 1" product or Petroleum Contaminated Water. Therefore, the regular tank needs to be pumped out to less than 1" to remain out-of-service. OR, the tank(s) can be closed-in- place (which would require the tanks to be cleaned and filled with an inert material). No dispensers remain on site, and the dispenser piping is capped. No buildings are present. Non compliance letter mailed to facility.
