Neither document stated the exact amount of product released nor collected. The INF states a "small amount". The facility stated in a 6-4-24 email that the leak was "very small" and "Possibly less than 1 gallon was spilled, and it was cleaned with about 3 to 4 absorbent pads.". The investigation stated that Tank #6 had a hole in the bottom. The facility did not provide integrity tests, however, did provide photos of the repair and have since removed the tank. See attachments for INF, investigation report, email response, and photos of the hole in tank #6. Corrective action satisfied for the violation.

Description: A Routine Compliance Inspection was conducted on October 5, 2023, with Elsa Portanyi, Environmental Specialist II, with the Florida Department of Environmental Protection (Department), Marathon Office, and Brandon Lopez, Warehouse Manager, of Sunshine Gasoline Distributers, Inc. The facility was purchased by the current owners in 2021 and operates as a bulk fuel distributor/depot. The facility’s last regulated storage tank inspection was conducted in 2018. EQUIPMENT (EQ) REVIEW: TANKS: The facility has registered three (3) 20,000-gallon, vehicular diesel, aboveground storage tanks (AST), three (3) 20,000-gallon, unleaded gasoline, ASTs, three (3) 2,000-gallon, new/lube oil, ASTs, and one (1) 8,000-gallon new/lube oil AST. All ten (10) registered tanks are made of steel per the facility's registration. The six (6) 20,000-gallon ASTs and two (2) of the new/lube oil ASTs were installed in 1966, one (1) 2,000-gallon new/lube oil AST was installed in 1995, and the 8,000-gallon new/lube oil AST was installed in 1998. One (1) 20,000-gallon, vehicular diesel, AST is compartmented and identified as tank “2” in the facility’s registration with the Department. One (1) 20,000-gallon, unleaded gasoline, AST is compartmented and identified as tank “1” in the facility’s registration with the Department. The 8,000-gallon, new/lube oil, AST is compartmentalized and identified as tank “11” in the facility's registration with the Department. The tank numbers assigned to the tanks by the facility do not correlate with the tank numbers in the facility's registration with the Department. The tank numbers assigned by the facility for the bulk tanks are from left to right and facing away from US1: Tank #1 and Tank #2 are horizontal bulk tanks, Tanks #5 and #6 are vertical bulk tanks. Tanks #4 and #3 are vertical bulk tanks located directly behind Tanks #5 and #6, respectively. The 2,000-gallon new/lube oil ASTs are horizontal and located to the right of the bulk tanks in the same secondary containment. The new/lube oil tank # given by the facility, assigned from closest to US 1 to furthest, are as follows: Tank #7, Tank #8, Tank #9 (removed), and Tank #10. All three (3) new/lube tanks are out of service. The facility failed to report the change of service to the Department. The 8,000-gallon, new/lube oil, tank was assigned #11 by the facility and had been removed from the property. The facility failed to report the removal of the tank and the closure report to the Department. One (1) 20,000-gallon AST (Alias Tank #6) was not in-use due to a release that occurred at the base of the single-walled bulk tank. The facility failed to provide an incident notification report (INF) and/or discharge report form (DRF) in a timely manner and failed to report the change of service of Tank #6 to the Department. The regulated storage tanks did not have American Petroleum Institute 1637 (API 1637) color coding on the tanks themselves. The site had a discharge of 50-100 gallons of diesel in 1989 due to overfill and is enrolled in Petroleum Restoration Program. SPILL CONTAINMENT: The facility had nine (9) regulated ASTs located in a singular concrete secondary-containment. The concrete is not lined nor coated with Department-approved coating. There were plants observed to be growing in the secondary containment and from beneath the bulk storage tanks. Cracks were also noted throughout the secondary containment. The facility had six (6) remote fill ports located in a singular concrete secondary-containment. The fill ports' concrete containment is not lined or coated with Department-approved coating. Two (2) 5-gallon buckets were located within the concrete containment, the material of the 5-gallon buckets is unknown. The concrete containment and the two (2) 5-gallon buckets contained greater than 1 inch of heavily discolored liquid. Multiple petroleum absorbent pads were observed within the concrete secondary-containment that were discolored and saturated beyond capacity. The colors on the six (6) remote fill ports did not follow API 1637 color coding. The fill ports had hoses attached to the piping as an extension for receiving fuel. The extensions reached beyond the concrete secondary-containment and do not have their own spill containment equipment beyond the concrete containment area. Sheen was observed on standing water located outside of the containment area. Facility failed to provide an incident notification form (INF) for the event in a timely manner (72 hrs). OVERFILL PROTECTION: The facility's registration stated that monitoring for the tanks is provided by visual inspection. The bulk tanks are equipped with fuel level glasses. The location of the fuel level glass is not visible from the fill ports and requires that a second person monitor the level during times of fueling. The gauges are not marked at 90% capacity. SUMPS: The facility had two (2) transition sumps; one (1) located at the base of the dispenser ("loading rack") and one (1) in front of the secondary containment of the regulated storage tanks. The sumps were dry, however, emitted an odor of petroleum and were discolored at the base. The piping in-between the two (2) transition sumps are underground. Facility did not have integrity testing records for transition sumps. DISPENSERS CONTAINMENT: The facility had one fuel dispenser mounted on a metal "loading rack". Product is dispensed to the top of fueling trucks via metal piping. A 5-gallon bucket is used as a catchment for the dispenser and is hung on the piping under the mouth of the dispenser. The dispenser piping had rusting. The fuel dispensing area did not have an impervious secondary containment area. RELEASE DETECTION: The facility's registration stated that monitoring for release detection is provided by visual inspection. Facility is not required to conduct AOT for release detection. DOCUMENTS REVIEW: PLACARD: Placard was dated from June 30, 2023, to June 30, 2024. FINANCIAL RESPONSIBILITY: Storage Tank Certificate of Insurance provided by Zurich American Insurance Company and Allied World National Assurance Company dated 4/21/23 - 4/21/24. Facility was missing the minimum 3-year record (2020 - 2023) for financial responsibility as well as records for 2019 - 2020. MONTHLY VISUAL INSPECTION REPORT: Facility provided 3 months of monthly monitoring (8/1/23, 9/1/23, and 10/3/23) which were conducted by Discovery Tanks. Monthly monitoring records did not identify which tank the observations pertained to and did not provide sufficient evidence that all ten (10) tanks were being monitored monthly. Facility was missing 3-year history of monthly monitoring for all ten (10) regulated storage tanks. AMERICAN PETROLEUM INSTITUTE STANDARD 653 (API std 653): The facility did not have records of API std 653 inspections for the six (6) bulk tanks. The facility stated that no API std 653 inspections have been conducted on any of the six (6) bulk tanks in the past. TANK UPGRADE: The facility provided a "Tank Upgrade" report that was conducted over the course of multiple visits in 2022 by Superior Services Tank Compliance Testing. Per the report, the work order for the Tank Upgrade was initially to "Remove residual, clean, wash, inspect, repair any internal/external deficiencies identified, line floor up to 6ft.". The 2022 Tank Upgrade stated: Tanks #1 and #2 had no areas of concern. Tank #3 had "several areas of concern"; "The paint coating has failed and is allowing water to seep behind the coating, creating rust scale on the tanks"; repairs were made. Tank #4 had one rust hole which was repaired with 1/4 inch thick plate. Tank #5 had a repair to a hole in the top of the tank and "The paint coating has failed and is allowing water to seep behind the coating, creating rust scale on the tanks"; repairs were made. Tank #6 had "no areas of concern" during the March 2022 inspection. A "wet spot" was observed on the exterior of the tank during an August 2022 visit. The tank had a breach at its base and was repaired by wielding a steel plate over the area. Please see attached report for list of violations, areas of concerns (AOC), corrective actions and violation comments.
