Description: Tom Bates, from Collier County, called Nicholas Costanza to check whether he had obtained Financial Responsibility. This is to resolve a long outstanding violation from 2019. I informed him of the violation and the state rule FAC 62-762. I also told him that the tank has to be closed because it has been out of service more than 10 years. He does not see why he has to get insurance or spend the money to close the tank when it has not been used for years, and he might want to use the tank some day. I tried to explain the rule to him and that he could close the tank in place, saving it for future use. He wants a rule copy mailed to him because he doesn't want email. He said call him after he has a chance to read the rule. In summary, he does not have insurance for the tank and the violation is not resolved.

Description: Out of service tanks with containment must be returned to service or permanently closed after 10 years, which would be September 2020. While registered as Out of Service, monthly release detection inspections are not required. The dike field must be kept in sound condition and was found to be satisfactory. Annual storage tank registration fees are due to the DEP each year by July 1. The regulated tank should be secured if it will not be closed. We also recommend the the other small tank is secured because this is an NFPA requirement and it apparently moved during the recent hurricane. FINANCIAL RESPONSIBILITY / INSURANCE In the past financial responsibility was not required while the tank is registered as Out of Service. However, the 2017 revisions to 62-762 FAC require insurance or other form of financial responsibility to be maintained. * Unless insurance is obtained, the FAC regulated tank must be closed within 90 days * CLOSURE If the facility will be closed, the tank may be closed in-place or removed and disposed (disposal receipt required). Notify the county prior to closure to ensure closure requirements will be met and to schedule inspections. County contacts are listed below. (a) Notification shall be received by the county in writing or electronic format between 30 and 45 days before the initiation of the work related to the change in service status or closure unless the county agrees to a shorter time period. Per FS 376.3077, "It is unlawful for any owner, operator, or supplier to pump or otherwise deposit any motor fuel into a tank required to be registered under section 376.303 FS, unless proof of valid registration is displayed on such tank itself or the dispensing or measuring device connected thereto or, where appropriate, in the office or kiosk of the facility where the tank is located." Penalties can be assessed to the facility owner for failure to properly register tank systems. Note that penalties can be assessed to the supplier that delivers motor fuel to an unregistered facility. Check the details on the placard. Do they agree with the location you are inspecting? Owners of multiple facilities may switch placards by mistake. Placards are not always issued or received in a timely manner at the change of year period (June and July). Provide the DEP Tallahassee phone number to the facility so they may resolve problems (850) 487-7077; (850) 488-3935. Check STCM in the registration/placard section for the date that the payment was made and the date that the placard was issued. The location of the placard in plain view can be subjective in interpretation: a. For vehicular fuel facilities, plain view is meant to allow the transport delivery driver to view the placard prior to delivering fuel. b. A legal definition is an exception to the general requirement of a valid search warrant to legitimize a search or seizure; a search implies prying into hidden places, and it is not a search to observe what is open to view.

Description: I returned to the site today to meet with Mr. Poczatek to confirm tanks were empty and fill out the registration form to place 1000-g tank out of service. The 1000-g tank (diesel) and 500-g tank (gas) were both in great condition and the dikefield was in tact with no noticeable cracks. The pumps were kept on the tanks and locks were placed on the pumps so that no one could get to them. The 500-g unregulated tank had approximately 11 inches of fuel in it. It was highly recommended to Mr. Poczatek to get the tank pumped out by a fuel hauler (for example, Evans Oil, Howco, EMC Oil) or find someone that could use the fuel and have it pumped out for their use. Once that is complete, the fill ports must be locked up. The tanks still need to be strapped down to the concrete dikefield to keep them from becoming airborne during a high wind & storm event. The electrical breakers to the tanks have been turned off. Property is for sale at this time. Once the property is purchased and a new owner decides to use or sell the tanks, our Department must be notified.
