Please note all facilities with open violations for 89 days are usually referred to enforcement. According to my records this facility has had violations open for 161 days. Please let me know as soon as possible if the violations has been resolved before it is referred to enforcement. The following violations remain open: Violation Code: 7065 Description: Storage tank system not visually inspected once a month. Explanation: There were no monthly visual inspection logs after 7/23/2021. Reportedly new staff were not completely aware of monthly visual inspection requirements. Corrective Action: Monthly visual inspections shall be performed at least once per calendar month no more than 35 days apart and must at a minimum show the tank condition, spill bucket, aboveground piping, and the tank interstice are being inspected. Begin performing and recording monthly visual inspections and submit logs for the next two months (February and March of 2022) to Citrus County Environmental Health. Violation Code: 7041 Description: Failure to designate, register, or annually test primary overfill protection device, Explanation: Annual operability testing of the overfill device (Morrison Bros. clock gauge with high level alarm) was due by 4/14/2020 and there was no testing documentation available at time of inspection. Corrective Action: Annual operability testing of the primary overfill device (Morrison Bros. Clock Gauge with high level alarm) shall be performed at least once per year no more than 12 months apart. Submit previous testing if available. If testing was not performed or results are not available perform operability testing and submit results to Citrus County Environmental Health. I will wait as long as I can to refer it, technically it should have been referred a while ago and I have the district contacting me telling me it needs to be sent over, if they contact me again I will explain what is going on and hopefully they will let me put it off. I’m not sure how aware you are of the normal fuel tanks testing but I am just looking for testing of the overfill device which is a Morrison Bros clock gauge. It can be done in house but most of the time it is done by a third party but that is up to you guys. And like I said, I believe Randall told me he was trying to get it scheduled so it is possible the test was already completed. Message: | Good afternoon, I am with the DEP Storage Tanks Program, I am writing concerning an open violation for the fuel tank at the Cobb Rd Water Reclamation Facility. I was previously dealing with Randall Trowbridge and I had not heard from him the last couple of times I tried to contact so I stopped by and the onsite personnel gave me your name. I am looking for testing of the primary overfill device which is a Morrison Bros Clock Gauge with high level alarm. Last time I talked to Randall I believe he told me it was getting done but then I never heard back from him and I understand now he is gone. The violation has been open for 307 days and it’s going to need to be referred to enforcement as they are usually referred when they are over 89 days but I was trying to wait because the testing was supposedly getting done. Anyway, let me know if you would be the person to contact for this. I have included a copy of the inspection report from when the violation was cited. There was another violation cited that has already been resolved, the only thing that remains open is for the overfill device. Per FS 376.3077, "It is unlawful for any owner, operator, or supplier to pump or otherwise deposit any motor fuel into a tank required to be registered under section 376.303 FS, unless proof of valid registration is displayed on such tank itself or the dispensing or measuring device connected thereto or, where appropriate, in the office or kiosk of the facility where the tank is located." Penalties can be assessed to the facility owner for failure to properly register tank systems. Note that penalties can be assessed to the supplier that delivers motor fuel to an unregistered facility. Check the details on the placard. Do they agree with the location you are inspecting? Owners of multiple facilities may switch placards by mistake. Placards are not always issued or received in a timely manner at the change of year period (June and July). Provide the DEP Tallahassee phone number to the facility so they may resolve problems (850) 487-7077; (850) 488-3935. Check STCM in the registration/placard section for the date that the payment was made and the date that the placard was issued. The location of the placard in plain view can be subjective in interpretation: a. For vehicular fuel facilities, plain view is meant to allow the transport delivery driver to view the placard prior to delivering fuel. b. A legal definition is an exception to the general requirement of a valid search warrant to legitimize a search or seizure; a search implies prying into hidden places, and it is not a search to observe what is open to view. | ||||||||||

The tank is labeled as to its product, diesel. The tank is used to operate a diesel generator and no dispenser is attached. Overfill prevention is a Morrison Clock Gauge (EQ #527). The clock gauge does not have the required overfill alarm, which must be installed by next inspection. The spill bucket is dry and clean, no leaks were observed. The aboveground piping is painted steel galvanized with the appropriate anti-siphon valve installed. There were no leaks in any of the above ground piping.
