A Permit Modification Application Was Submitted On May 15, 2008 And Is Under Review. A Notice Of Intent To Issue A Draft Permit Modification No 71455-Ho-010 Was Issued On September 3, 2008. The Modification Request Submitted Is To Expand The Storage Area Used For The Collection And Sorting Of Electronic Waste Destined For Recycling, Increase The Maximum Volume Of Electronic Waste Materials Stored And Update Related Closure Cost Estimates. No Violations Were Cited During The Hazardous Waste Inspection Of Veolia Tsd On July 18, 2006. | The Facility Is Designed To Recycle Mercury Containing Devices, Including Fluorescent Lamps, Hid Lamps And Mercury Containing Articles (Mcma). Fluorescent Lamps Are Recycled Using A Combination Of Manual And Automated Dry Separation Processes To Separate The Primary Components Of The Lamps: Glass, Aluminum And The Phosphor Powder. Glass And Aluminum Are Shipped Off-Site For Further Reuse. The Phosphor Powder Derived From The Fluorescent Lamps Is Accumulated On-Site And The Mercury Contained In The Powder Is Reclaimed Using A Retort Oven. In The Recycling Process Small Amounts Of Other Scrap Metals And Plastics Are Also Generated. Veolia Notified The Department In January 2010 Of Failure To Meet The 99% Recovery Rate Requirement For The First Half Of 2009. The Recovery Rate Reported By Veolia For This Time Period Was 98.3%. The Northwest District Had A Teleconference With Veolia To Discuss The Issue On September 10, 2009. Additional Mercury Recovery Data Was Requested By The District And Provided By Veolia For Review. Department Permitting, Legal, And Compliance Staff Met With Veolia Representatives In Tallahassee To Further Discuss The Issue On January 27, 2010. Veolia Proposed Several Solutions Including A Rule Variance. The Department Was Not Willing To Grant A Variance At This Point. Veolia Indicated That They Were Currently Able To Meet The 99% Recovery Rate If A Weighted Average Of Mercury Recovered From Powder And Arc-Tube Waste Streams Was Used. This Solution Is In Agreement With Florida Administrative Code Subsections 62-737.200(12) And 62-737.860(4) And Was Accepted By The Department. For This Solution Veolia Will Have To Continue To Demonstrate, At Least On A Semi-Annual Basis, That They Can Achieve A 99% Recovery Of The Total Mass Of Mercury Introduced Into Their Process During That Period. A Joint Epa And Fdep Inspection Was Conducted On December 06, 2010 Which Revealed Violations Of Resource Conservation And Recovery Act. Enforcement Action Was Taken By Fdep And A Subsequent Inspection On May 17, 2011, Confirmed The Facility To Have Returned To Compliance. | Department Personnel Aaron Mitchell, Received A Phone Call On January 13, 2012, From Veolia Operations Manager, Linda Dunwoody, In Regards To A Hg Residual Exceedance In Their Processed Glass From The Hg Reclamation Process. The Discovery Of The Exceedance Was Made During The Facility'S End Of Year Annual Review Of Data From Test Samples. A Subsequent Email Was Sent The Same Day Detailing The Event Timeline Along With Attached Test Sample Results And Spreadsheet Totals For The Calendar Year 2011. A Review Of The Emailed Information Showed That The Original Sample Results Were 5.3 Mg/Kg Hg On April 11, 2011. On April 15, 2011, A Retest Was Requested And The Results Reported As 6.3 Mg/Kg Hg. Both Samples Were An Exceedance Of The Permit Specific Condition #15 Weekly Sample Limit Of 5 Mg/Kg Hg. This Expansion Was Conducted So As To Allow For Onsite Storage Of Roll-Offs When Exceedances Of Permit Specific Condition #15 Occur And Allow For Permit Specific Conditions #18 To Be Satisfied Prior To Transportion Off-Site For Proper Disposal. A Consent Order Was Agreed To By Veolia And A Penalty Was Paid To The Epa Region 4 Rcra Compliance And Enforcement Division. This Inspection Was Conducted To Ensure That Veolia Had Returned To Compliance With State And Federal Hazardous Waste Regulations. | Department Personnel Conducted A Follow-Up Inspection Of Veolia To Ensure Violations Observed During The December 15, 2015, Routine Inspection Had Been Corrected. During This Site Inspection The Inspector Observed That The Facility Aisle Spacing Had Been In Violation Of Its Permitted Requirements, Containers Of Universal Wastes Were Open But Not Being Processed, A Signed Final Copy Of A Uniform Hazardous Waste Manifest Had Not Been Kept On File And Facility Personnel Were Not Properly Trained In The Requirements Of The Facility Operating Permit. During This Inspection The Inspector Observed That All Materials Were Within The Boundary Areas For The Storage Of Universal Waste In The Main Building. This Facility Is A Mercury Reclamation And Recovery Facility Located At 342 Marpan Lane In Tallahassee, Florida And Has Been In Operation Since 1995. Veolia Is Currently Operating With Two Drivers And Six Employees In The Transport And Processing Of Mercury Containing Lamps And Devices, Mercury Contaminated Debris, Electronic Waste, Batteries, Scrap Metal, And Pcb Waste.
