12/04/2008 Site Inspection Routine; CESQG (<100 kg/month) - Routine; VSQG (<100 kg/month) - Pre-Arranged; Used Oil Transfer Facility A Hazardous Waste Compliance Evaluation Inspection Was Conducted At This Facility On December 4, 2008. The Inspection Was Pre-Arranged. A File Review Indicated That The Facility Had Been Inspected By Hazardous Waste Personnel On 8/31/05. In Addition, A Review Of Comhaz (Compliance And Enforcement Tracking System For The Hazardous Waste Program) Indicated That Is Currently Listed As A Used Oil Transfer Facility. | The Facility Owns The Property. The Facility Is Connected To City Water And Sewer. The Facility Has 50 Employees. Ryder Truck Disposes Of Solid Waste For The Facility At The Okeechobee Landfill. Each Sub-Station Has An Oil Shed Similar To The One Located At The Fpl - Ft. Myers Emergency Facility. Transformers Are Brought To Each Sub-Station, Placed In The Oil Shed To Be Tested And Drained Of Mineral Oil. Damaged Transformers Are Shipped To Miami (Erc) For Repairs. The Floor Of The Oil Sheds Are Grated In Order To Allow The Used Mineral Oil To Drain To The Base Of The Shed (See Photographs 2 And 3). Used Mineral Oil Is Pumped Directly Out Of The Oil Shed Base By Transfer Truck. The Used Mineral Oil Is Collected By The Single Transfer Truck. Each Sub-Station Receives A Regular Scheduled Visited For The Purpose Of Collecting Used Mineral Oil. The Driver Uses A Chlor-N-Oil Test To Test The Halogen Levels Of The Used Mineral Oil. In The Event That The Halogen Level Is Higher Than 1,000 Ppm, A Sample Of The Used Mineral Oil Is Drawn And Sent To The Test Lab In West Palm Beach. The Facility Maintains The Results Of All Halogen Tests On File For A Minimum Of Three Years. The Facility Maintains Training Records For The Driver Of The Transfer Truck At The Facility. The Used Mineral Oil Is Pumped Out Of The Full Transfer Truck Into A Labeled 6,000 Gallon Double-Walled Above Ground Storage Tank (Ast) Located At The Fpl - Fort Myers Emergency Facility. The Registration Placard Number For The Ast Is 306569. The Placard Was Issued On 06/19/08 And Expires On 06/30/09. Atlantic Industrial Service Disposes Of The Used Mineral Oil. The Records Include The Name, Address, Epa Identification Number (If Applicable), Of The Generator, Transporter, Or Process/Re-Refiner Who Provided The Used Oil For Transport Along With The Quantity Of Used Oil Accepted, Date Of Acceptance, And Are Initialed By The Driver. It Was Recommended During The Inspection That The Signature Of The Used Mineral Oil Generator Be Included On The Record Along With The Signature Of The Driver Receiving The Used Mineral Oil. A Spill Containment Supply Cabinet Was Located To The Right Of The Oil Shed. The Used Oil Absorbent Booms Are Disposed With Solid Waste. Recycle Area The Recycle Area Is North Of The Environmental Office. Empty Drums Are Stored In The Environmental Area. The Majority Of The Empty Drums Were Stored On Their Sides With The Bungs Parallel To The Ground. The Remaining Empty Drums Were Managed Upside Down To Prevent The Accumulation Of Rainwater. The Empty Drums Are Maintained On-Site To Manage Any Waste Material In The Event Of A Spill. Recyclable Material Such As Lead, Pins, Sky Blue Arrestors, Porcelain Arrestors, Spent Mercury Containing Devices (Such As Ballasts, Hids, Etc.), Old Photo Cells, Empty Aerosol Canisters, Sodium Vapor B

03/21/2013 Site Inspection Routine; CESQG (<100 kg/month) - Routine; Used Oil Transporter - Routine; Used Oil Transfer Facility - Routine; VSQG (<100 kg/month) A Hazardous Waste Compliance Evaluation Was Conducted At This Facility On March 21, 2013. A File Review Indicated That The Facility Had Previously Been Inspected 8/31/2005 And 12/4/2008. Fpl Owns The Property Which Is Connected To City Sewer And Water. The Facility Has Approximately 70 Employees. The Facility Is Registered As A Used Oil Transporter And A Used Oil Transfer Facility. Fleet Maintenance Is Also Located At This Facility And Generates Conditionally Exempt Small Quantities Of Hazardous Waste. A Conditionally Exempt Small Quantity Generator (Cesqg) Generates Less Than 220 Pounds Of Hazardous Waste In A Calendar Month. | Several Buildings On The Property Are Used For Parts Storage, Oil Spill Equipment Storage, And Offices. No Wastes Were Noted To Be Stored In These Buildings. Solid Waste Is Picked Up By The City Of Fort Myers Or Hauled To Okochobee Landfill. Spent Fluorescent Lamps Generated From The Office Buildings On-Site Are Managed By Facilities Maintenance And Would Go To Fpl'S Gladiolus Service Center Located At 15834 Winkler Road In Fort Myers (Fld000807651). Used Oil Transporter/Transfer Facility The Facility Is Registered As A Used Oil Transporter And A Used Oil Transfer Facility. The Facility Has A Spill Response Plan And Maintains Employee Training Records. Training Records For Isiah Bryant Were Reviewed And Noted To Include Annual 8 Hour Hazwopper Refresher Courses. The Facility Transports Its Own Used Oil Generated At Its Own Non-Contiguous Operations To This Central Facility For Storage Prior To Having The Used Oil Picked Up By A Certified Used Oil Transporter And Is Therefore Not Subject To The Record Keeping And Reporting Requirements Of Rule 62-710.510, F.A.C., And Is Exempt From Rule 62-710.600, F.A.C. With The Exception Of Financial Responsibility Requirements. A Certification Of Financial Responsibility Good From 5/1/12 To 4/30/13 Was Available For Inspection. Fpl Maintains And Repairs Aerial And Pad Mounted Transformers Located Throughout Their Service Area. The Facility Subcontracts With Sws Environmental Services To Assist With Oil Spill Response, Management, And Record Keeping. Oil From Transformers Not Clearly Labeled "No Pcbs" Is Tested On Location Using A Chlor-N-Oil Test To Determine If Pcbs Are Present. If The Oil Fails The Chlor-N-Oil Test A Sample Is Collected And Sent To Fpl'S Physical Distribution Center (Pdc) For Further Analysis. The Wastes Associated With Clean Up Of That Transformer Are Brought Back To This Facility And Stored In A Yellow Plastic Containment Pallet Labeled "Mineral Oil Pending Analysis". The Secondary Containment Pallet Can Contain 60 Gallons. The Container Was Empty, Clean And In Perfect Condition At The Time Of This Inspection. (See Photos) Any Oily Debris Or Used Mineral Oil Determined To Contain >50ppm Pcbs Is Tracked On An Internal Shipping Paper And Sent To The Pdc Which Is Located At 2455 Port West Blvd. In Riviera Beach. A Review Of Recent Shipping Papers Indicated 200# Of Pcb Contaminated Soil Was Shipped To The Pdc On 7/20/2012. Damaged Transformers, Oily Debris (Dirt, Absorbents) And Used Mineral Oil Not Containing Pcbs Are Brought Back To One Of The Fpl Service Centers And Stored In A Used Oil Shed (Photos Of The Shed Are Included In The Previous Inspection Report). The Used Oil Shed At This Location Is Constructed Of Metal And The Seams Are Welded To Ensure Integrity. A Grated Containment Area Is Built Into The Floor Of The Shed. Previous Correspondence In Department Files Indicates That The Shed Is A Double-Walled, Self-Contained Unit Capable Of Holding 150% Of The Volume Of Oil In The Largest Transformer That May Be Placed Into The Shed. The Outside Of The Shed Is Labeled "Used Oil Only <50 Ppm". At The Time Of The Inspection One Transformer Labeled With A Serial Number And Address Was Stored In The Shed. 01/15/2019 Site Inspection Routine; CESQG (<100 kg/month) - Routine; Used Oil Transporter - Routine; Used Oil Transfer Facility - Routine; VSQG (<100 kg/month) A Compliance Evaluation Inspection Was Conducted At The Florida Power & Light Company [Fpl] Ft Myers Service Center [Facility] On January 15, 2019 To Determine The Facility'S Compliance Status With State And Federal Hazardous Waste, Used Oil And Universal Waste Regulations. A File Review Indicates The Facility Was Previously Inspected On 8-31-2005, 12-4-2008 And 3-21-2013. Fpl Owns The Property Which Is Connected To City Sewer And Water. The Facility Has Approximately 50 Employees. The Facility Is Registered As A Used Oil Transporter And Used Oil Transfer Facility. The Facility Also Conducts Fleet Maintenance On Approximately 150 Trucks Generating Used Oil, Used Oil Filters, Spent Lead Acid Batteries, Oily Rags, Scrap Metal, Spent Parts Washer Filters And Hazardous Waste In The Form Of Waste Aerosols. The Facility Was Determined To Be A Very Small Quantity Generator [Vsqg] Of Hazardous Waste. A Vsqg Generates Less Than 220 Pounds Of Hazardous Waste In A Calendar Month; And Never Accumulates More Than 2,200 Pounds Of Hazardous Waste; Or 2.2 Pounds Of Acutely Toxic Hazardous Waste At Any Time. The Facility Also Generates Spent Sodium Vapor Street Lamps And Spent Fluorescent Lamps Which Are Managed As Universal Waste. We Arrived On-Site And Reviewed The Purpose Of The Inspection With Pam Shoosmith. We Were Escorted Throughout The Inspection By Ms. Shoosmith. | This Facility Is Responsible For Maintaining And Repairing Aerial And Pad Mounted Transformers Located Throughout Their Service Area. The Facility Subcontracts With National Recovery Company (Nrc)/Sws Environmental Services Who Is On Call 24/7 To Assist With Oil Spill Response, Management And Recordkeeping. Fpl Transports Its Own Used Oil Generated At Its Own Non-Contiguous Operations To This Facility For Storage Prior To Having The Used Oil Picked Up By A Certified Used Oil Transporter And Is Therefore Not Subject To The Recordkeeping And Reporting Requirements Of Rule 62-710.510, F.A.C. And Is Exempt From Rule 62-710.600, F.A.C. With The Exception Of Financial Responsibility Requirements. A '2018 Statement Of Self Insurance For Used Oil Transporter' Was Provided With The Facility'S Registration Renewal Package. Used Mineral Oil Generated From Damaged Equipment Labeled As Non-Pcb [Polychlorinated Biphenyls] Is Pumped Into The Collection/Transfer Truck And Off-Loaded Into A Storage Tank At The Facility. Oily Debris Including Impacted Soil And Absorbent Material Is Collected In Roll-Offs Or Drums And Transported To The Facility. Nrc/Sws Transports The Solid Oily Waste And Debris From The Facility Directly To Okeechobee Landfill For Disposal. Disposal Documentation Was Reviewed. It Was Noted And Discussed That On Several Non-Hazardous Manifests, The Epa Id# For The Transporter And Disposal Facility Were Incorrect And/Or Reversed. Used Mineral Oil Generated From Damaged Equipment Without A Non-Pcb Label Is Tested In The Field With Chlor-N-Oil 50 Kits To Determine If Pcbs Are Present (<50ppm). If The Sample Fails, It Is Tested Again With The Chlor-N-Oil 500 Kits To Determine If It Is Less Than 500ppm Pcb. After The Field Testing Is Completed, Another Sample Is Collected And Sent To Fpl'S Laboratory At The Physical Distribution Center [Pdc], 2455 Port West Blvd., Riviera Beach, For Further Confirmation. Oil Filled Equipment And Debris Are Stored In The Oil Shed, Bagged And Labeled, Until Laboratory Analysis Results Are Obtained. Any Oily Debris Or Used Mineral Oil Determined To Contain >50ppm Pcbs Is Tracked On An Internal Shipping Paper And Sent To The Pdc. Ms. Shoosmith Indicated They Have Had Not Shipped Any Pcb Containing Material For Several Years. The Oil Shed Is Constructed Of Metal And The Seams Are Welded To Ensure Integrity. A File Review Reflects Previous Inspections Were Conducted On 8-31-2005, 12-04-2008, 3-21-2013 And 01-15-2019. The Following Is A Summary Of My Observations. Fpl Owns The Property Which Is Connected To City Water And Sewer. The Facility Has Approximately 50 Employees. This Facility Is Currently Registered With Fdep As A Used Oil Transporter And Used Oil Transfer Facility. The Registration Expires 06-22-2022. A File Review Reflects The Storage Tank System (Facility Id# 8519172) Was Last Inspected By Lee County Division Of Natural Resources On 02-09-2021 And Determined To Be In Compliance. Financial Responsibility For The Tank System Was Verified During This Inspection To Be Current [05-01-21 To 04-30-2022]. The Storage Tank Placard #598969 Is Maintained On-Site And Was Issued 05-27-2021 And Expires 06-30-2022. Maintenance Is Conducted On Approximately 150 Trucks Generating Used Oil, Used Oil Filters, Spent Lead-Acid Batteries, Oily Rags, Scrap Metal, Spent Parts Washer Filters And Hazardous Waste In The Form Of Waste Propane Containers. The Facility Was Determined To Be A Very Small Quantity Generator (Vsqg) Of Hazardous Waste. A Vsqg Generates Less Than 220 Pounds Of Hazardous Waste In A Calendar Month; And Never Accumulates More Than 2,200 Pounds Of Hazardous Waste Or 2.2 Pounds Of Acutely Toxic Hazardous Waste At Any Time. Disposal Documentation Was Reviewed. 04/19/2023 Site Inspection Routine; Used Oil Transporter - Routine; Used Oil Transfer Facility On April 19, 2023 (04/19/2023), Pamela Coffin With The Florida Department Of Environmental Protection (“Dep” Or “Department”) Conducted A Routine Inspection At The Florida Power & Light Company Ft Myers Lee & Thompson Service Center (“Fpl” Or “Facility”), Located At 2425 Thompson Street, Fort Myers, Lee County, Florida. The Facility Was Inspected To Determine Its Compliance With The State And Federal Hazardous Waste, Used Oil, And Universal Waste Rules And Regulations Described In Title 40, Code Of Federal Regulations (Cfr) Parts 260-268, 40 Cfr Part 273, And 40 Cfr Part 279, Adopted And Incorporated By Reference In Rules 62-710 And 62-730, Florida Administrative Code (F.A.C.). The Inspector Was Accompanied By Genevieve Grah From The Dep. The Inspectors Were Escorted Around The Facility By Fpl Sr. Environmental Specialist Kelli Gross. Upon Arrival At The Facility, We Presented Our Credentials And Explained The Purpose Of The Inspection. Ms. Gross Provided Access And Was Present Throughout The Inspection. The Facility Is Owned By Fpl And Is Connected To City Water And Sanitary Sewer. The Facility Employs 68 Personnel And Operates 24 Hours A Day, Seven Days A Week. Notification History This Facility Is Currently Registered With The Department As A Used Oil Transporter And Used Oil Transfer Facility. The Registration Expires 06-30-2024. A File Review Reflects The Storage Tank System (Facility Id# 8519172) Was Last Inspected By Lee County Division Of Natural Resources On 02-09-2021 And Determined To Be In Compliance. The Facility Also Generates Spent Sodium Vapor Streetlamps, Spent Fluorescent Lamps And Spent Aerosols Which Are Managed As Universal Waste. Inspection History A File Review Reflects Previous Inspections By The Department Were Conducted On 8/31/2005, 12/04/2008, 03/21/2013, 01/15/2019, And 12/08/2021. The Facility Was Found To Be Out Of Compliance During The Most Recent Inspection On 12/08/2012 Resulting In Consent Order Actions For The Following Violations: 40 Cfr 279.45(A), 62-710.800(1), F.A.C. The Facility Must Establish Procedures To Ensure Used Oil Is Not Stored Longer Than 35 Days Or Must Meet The Requirements For A Used Oil Processing Facility. 62-710.850(5)(A) Used Oil Filters Shall Be Stored In Above Ground Containers Which Are Clearly Labeled “Used Oil Filters.” Steel-Toed Boots And Safety Glasses Were The Only Personal Protective Equipment (Ppe) Required To Enter The Facility. | This Facility Is Responsible For Maintaining And Repairing Aerial And Pad Mounted Transformers Located Throughout Their Service Area.
