The Facility Was Given 30 Days To Return To Compliance. | Ricky'S Oil Service, Inc. (Ros) Is A Permitted Facility Authorized To Process Used Oil. Ros Is Also A Registered Used Oil Transporter, Used Oil Transfer Facility, Used Oil Marketer, Used Oil Filter Transporter, And A Used Oil Filter Transfer Facility. The Facility Consists Of A Tank Farm Inside Secondary Containment, Two Office Trailers, And A Small Parking Lot And Is Totally Surrounded By A Security Fence. The Facility Is Situated On A 0.7 Acre Site In A Heavy Industrial Area, And Is Served By City Water And Sewer. The Facility Has Been Operating On This Site For At Least The Last 30 Years And Employs 12 People. Compliance History: Ros Was Last Inspected On March 22, 2007, Only Two Items Were Requested At The Time Of The Inspection And The Facility Was Brought Back Into Compliance Without Enforcement On April 18, 2007. On March 6, 2008, A Notice Of Violation Was Issued To Mr. Ricci And The Facility For Operating A Permitted Facility For Three Days With An Expired Permit. The Facility Is Required By Regulation To Submit A Permit Renewal Application At Least 60 Days Prior To The Date Of Permit Expiration. This Matter Was Resolved Through A Consent Order On May 21, 2008. | Ros Has 11 Tanks On Site With A Total Capacity Of 25,000 Gallons. All Oil Is Offloaded To Tank Eight Unless It Has A Water Content Of Less Than Five Percent. In This Is The Case, The Oil Would Be Considered On-Spec And Is Stored In One Of Ros'S Finished Product Tanks For Marketing To Their Customers. Only Tank Eight Is Used For Processing And Ros Only Does Passive Processing; No Heat Is Used. However, Emulsifier Is Sometimes Added To The Tank To Aid In Oil/Water Separation. The Wastewater That Is Generated From This Process Is Shipped To Either Cliff Berry'S Miami Facility Or Raider Environmental Services, Also Located In Miami. Also Stored Within The Secondary Containment Structure Are Two 20 Yard Rolloffs, One For Used Oil Filters And The Other For Oily Solids. Ros Ships The Used Oil Filters To Us Foundry In Miami And The Oily Solids Are Sent To The Central Landfill In Broward County. Inspection: The Facility Inspection Revealed No Used Oil Management Issues. Records Review: The Inspector Reviewed Acceptance And Delivery Logs For Used Oil. Manifests Were Than Compared To The Acceptance Logs And It Was Found That Ros Was Not Using The Epa Id Numbers Of The Generators, When Applicable. Training Records And Facility Inspection Logs Were Available For Review And Appeared To Be In Order. A Review Of The Facility'S Contingency Plan Revealed That The Plan Did Not Indicate The Location Of The Facility'S Emergency Response Equipment And Did Not Include The Phone Numbers Of The Local Authorities. The Labeling Had Accidentally Been Reversed When The Tanks Were Recently Painted And Tank #9 Actually Contained Used Oil And Tank #10 Actually Contained Antifreeze. Records Review: A File Review Noted That The General Facility Inspection Log Didn'T Meet The Standards Of 40 Cfr 279.52, As The Log Did Not Document That Detailed Inspections Of Emergency Response, Communications Or Security Equipment Were Performed. The Log Indicated Inspections Of The Tank Systems Were Only Performed Monthly. The Permit For This Facility States That Inspections Of The Tank Systems Are To Be Documented Weekly. It Was Also Noted That The Facility'S Delivery Manifests Didn'T Include The Epa Id Numbers Of The Destination Facilities, When Applicable. Additionally, From October 2010 And On, The Delivery Records For The Used Oil Filters Did Not Include The Manifests Numbers For Each Set Of Pick-Ups Included In That Load. On November 11, 2013, The Department Received Documentation And Photos Demonstrating That All Of The Issues Relating To The Physical Tour Of The Facility Had Been Resolved. | Ros Has 11 Tanks On Site With A Total Capacity Of 25,000 Gallons. Behind The Red Cargo Trailer And Along The Fence Line Were Two Oversized Yellow Plastic Containers That Were Covered With A Tarp And Appeared To Contain Used Oil. Upon Removing The Tarp, It Was Discovered That One Of The Two Containers Had Oily Water On Top And One Or Both Of Those Containers Could Possibly Have Been Leaking As There Was A Small Area Of Stained Soil On The Ground In Front Of The Containers. In That Same Area Was A Black Drum Which Also Appeared To Contain Used Oil. It Was Also Observed That Some Of The Used Oil Filter Containers Brought Into The Facility On The Day Before The Inspection Were Still Waiting For Consolidation And Had Not Been Properly Labeled. . Records Review: The Facility'S Contingency Plan Was Adequate; However, The Facility Couldn'T Produce Documentation Proving That The Contingency Plan Had Been Distributed To The Local Authorities. All Other Records Appeared To Be In Order: I.E. The Person Who Should Have Been Signing These Documents As Received Was Made Aware Of The Situation. The Inspector Explained That Even Though Their Own Drivers Were Bringing In The Loads, These Signatures Were Necessary To Complete The Acceptance Protocols Per The Used Oil Regulations. During The Inspection, Ros Was Represented By Mr. Rick Smerkers, The General Manager Of The Facility. The Dep Was Represented By Ms. Norva Blandin, An Environmental Specialist Iii. Ricky'S Oil & Environmental Services Llc (Ros) Is Situated On A 0.72 Acre Site In A Heavy Industrial Area. The Facility Has Been In Operation At This Site For Approximately 65 Years, And There Are Currently Twelve (12) Employees. The Entire Facility Is Connected To City Water And Sewer. The Facility'S Most Recent Used Oil Handler Notification Was Filed With The Department On 02/27/2017, Which Characterized Ros As A Used Oil Processor, A Used Oil Transporter, A Used Oil Transfer Facility, A Used Oil Marketer, A Used Oil Filter Transporter, And A Used Oil Filter Transfer Facility. The Notification Form Registration Is Set To Expire On 06/30/2018. The Facility Was Most Recently Inspected By The Dep On 04/02/2015. One (1) Minor Recordkeeping Violation Was Noted. Compliance Without Enforcement (Cwoe) Was Pursued, As The Facility Returned To Compliance (Via Submittal Of The Missing Recordkeeping Information To The Department) Within Fifteen Days Of The Inspection. Ppe (Personal Protective Equipment) Was Required To Enter This Facility. The Inspectors Wore Safety Boots Throughout The Inspection. | Ros Is A Permitted Facility Authorized To Handle, Process, Transport, And Market Used Oil And Used Oil Filters. The Facility Consists Of A Tank Farm Contained Within Secondary Containment, Two Office Trailers, And A Small Parking Lot. The Ros Facility Is Completely Surrounded By A Security Fence. Mr. Rick Smerkers Accompanied The Inspector Throughout The Used Oil Compliance Evaluation Inspection Of The Ros Facility. Ros Has Eleven (11) Tanks On Site That Have A Total Aggregate Capacity Of 160,000 Gallons. Ros Maintains A Fleet Of Eleven (11) Vehicles, With Which Facility Personnel Transport Used Oil From Ros' Clients (I.E. Used Oil Generating Facilities) To The Ros Facility Site. All Used Oil Shipments Arriving At The Facility Are Offloaded Into Tank Eight, Unless The Shipment'S Water Content Is Less Than Five Percent. If This Is The Case, The Shipment'S Used Oil Is Considered On-Spec. The On-Spec Used Oil Is Then Stored In One Of Ros'S Finished Product Tanks And Marketed To The Facility'S Used Oil Customers. Only Tank Eight Is Used For Used Oil Processing, And Ros Only Engages In Passive Processing (I.E. No Heat Is Used To Process The Used Oil). However, An Emulsifier Is Sometimes Added To Tank Eight To Aid In Oil/Water Separation. The Waste Water That Is Generated As A Result Of This Emulsifying Process Is Collected, Handled, And Stored As Oily Water Waste In Properly Closed And Labeled Containers Within The Facility'S Main Storage Area. Ros Also Uses An Oil Filtration System As A Part Of Its Oil Processing Operations. More Specifically, Ros Filters The Used Oil Shipments Determined To Be On-Spec Before Storing Them In The Facility'S Finished Product Tanks. Any Sludge Waste Generated From This Oil Filtration Process Is Collected, Handled, And Stored As Oily Solid Waste (I.E. Stored Along With The Facility'S Oily Rag Waste In Properly Closed And Labeled Containers) In The Facility'S Main Storage Area. Upon Arrival At The Facility, Any Used Oil Filters Are Completely Drained By Facility Personnel. The Drained Used Oil Filters Are Then Accumulated On-Site In One (1) Large, Open Container. Once The Used Oil Filter Container Is Completely Filled, Ros Personnel Remove The Filters And Pack Them Into Properly Labeled And Sealed Containers, Which Are Stored In The Facility'S Main Storage Area And Are Ultimately Shipped Off-Site As Scrap Metal For Recycling. The Facility Also Has Two (2) Roll-Offs In Its Tank Farm Area. These Two (2) Roll-Offs

The Inspector Was Accompanied By Ros Representatives Rick Smerkers; General Manager. Ricky'S Oil & Environmental Services Llc (Ros) Is Situated On A 0.72 Acre Site In A Heavy Industrial Area. The Facility Has Been In Operation At This Site For Approximately 67 Years, And There Are Currently Twelve (12) Employees. The Entire Facility Is Connected To City Water And Sewer. Notification History: The Facility'S Most Recent Used Oil Handler Notification Was Filed With The Department On 06/8/2018, Which Characterized Ros As A Used Oil Processor, A Used Oil Transporter, A Used Oil Transfer Facility, A Used Oil Marketer, A Used Oil Filter Transporter, And A Used Oil Filter Transfer Facility. The Notification Form Registration Is Set To Expire On 06/30/2019. Inspection History: The Facility Was Most Recently Inspected By The Dep On 08/3/2017. Four (4) Violations Were Observed, And Compliance With Formal Enforcement Was Pursued. The Facility Returned To Compliance On 11/22/2017. Personal Protective Equipment (Ppe) Was Required To Enter This Facility. The Inspector Wore Safety Glasses And Safety Boots Through The Inspection. | Ros Is A Permitted Facility Authorized To Handle, Process, Transport, And Market Used Oil And Used Oil Filters. The Facility Consists Of A Tank Farm Contained Within Secondary Containment, Two Office Trailers, And A Small Parking Lot. The Ros Facility Is Completely Surrounded By A Security Fence. Mr. Rick Smerkers Accompanied The Inspector Throughout The Used Oil Compliance Evaluation Inspection Of The Ros Facility. Since The Last Inspection Conducted On 8/3/2017, Ros Has Not Made Any Changes To The Layout Of The Facility Or It Locations Of The Tanks. Ros Has Eleven (11) Tanks On Site That Have A Total Aggregate Capacity Of 160,000 Gallons. Ros Maintains A Fleet Of Eleven (11) Vehicles, With Which Facility Personnel Transport Used Oil From Ros' Clients (I.E. Used Oil Generating Facilities) To The Ros Facility Site. All Used Oil Shipments Arriving At The Facility Are Offloaded Into Tank Eight, Unless The Shipment'S Water Content Is Less Than Five Percent. If This Is The Case, The Shipment'S Used Oil Is Considered On-Spec. The On-Spec Used Oil Is Then Stored In One Of Ros'S Finished Product Tanks And Marketed To The Facility'S Used Oil Customers. Only Tank Eight Is Used For Used Oil Processing, And Ros Only Engages In Passive Processing (I.E. No Heat Is Used To Process The Used Oil). However, An Emulsifier Is Sometimes Added To Tank Eight To Aid In Oil/Water Separation. The Waste Water That Is Generated As A Result Of This Emulsifying Process Is Collected, Handled, And Stored As Oily Water Waste In Properly Closed And Labeled Containers Within The Facility'S Main Storage Area. Ros Also Uses An Oil Filtration System As A Part Of Its Oil Processing Operations. More Specifically, Ros Filters The Used Oil Shipments Determined To Be On-Spec Before Storing Them In The Facility'S Finished Product Tanks. Any Sludge Waste Generated From This Oil Filtration Process Is Collected, Handled, And Stored As Oily Solid Waste (I.E. Stored Along With The Facility'S Oily Rag Waste In Properly Closed And Labeled Containers) In The Facility'S Main Storage Area. Upon Arrival At The Facility, Any Used Oil Filters Are Completely Drained By Facility Personnel. The Drained Used Oil Filters Are Then Accumulated On-Site In One (1) Large, Open Container. Once The Used Oil Filter Container Is Completely Filled, Ros Personnel Remove The Filters And Pack Them Into Properly Labeled And Sealed Containers, Which Are Stored In The Facility'S Main Storage Area And Are Ultimately Shipped Off-Site As Scrap Metal For Recycling. Once The Used Oil Filter Container Is Completely Filled, Ros Personnel Remove The Filters And Pack Them Into Properly Labeled And Sealed Containers, Which Are Stored In The Facility'S Main Storage Area And Are Ultimately Shipped Off-Site As Scrap Metal For Recycling. During The Inspection, The Inspectors Observed Two Open 20-Cubic Yard Roll-Off Containers, And Numerous Open 55-Gallon Drums Holding Used Oil Filters Which Were Exposed To The Elements, It Was Also Raining During The Inspection, And Throughout The Day [62-710.850(5)(A) F.A.C.]. The Facility Was Requested To Conduct Confirmatory Sampling Of The Area To Ensure No Contamination Has Occurred. Submittals Pertaining To The Confirmatory Sample Were Submitted On 1/14/2022 And 1/12/2022. The Facility Conducted A Source Removal And Took Three Soil Samples And Provided The Results Via Email On 1/4/2021. Based Of The Results, Two Samples Were Above Both Residential And Commercial Soil Cleanup Target Levels Specified In Table I Of Chapter 62-777 F.A.C., And One Sample Was Above Residential Soil Cleanup Target Levels. Due To The Results, The Facility Conducted Another Source Removal And Provided The Results On 1/12/2021. Based Of The Results, One Sample Was Above Both Residential And Commercial Soil Cleanup Target Levels Specified In Table I Of Chapter 62-777 F.A.C. The Facility Stated They Would Conduct Another Source Removal And Sample Once Again. To Date The Facility Has Removed About Four Cubic Yards Of Soil. Notification History: Ricky’S Initially Notified With The Department As A Transporter, Transfer, And Processor For Used Oil On 10/17/1990. The Facility’S Most Recently Registered With The Department On 03/20/2023 As A Used Oil Transporter For Hire, Transfer Facility, Processor, Marketer, Filter Transporter, Filter Transfer Facility, Expiring On 06/20/2024. The Facility Also Registered As A Very Small Quantity Generator (Vsqg) On 01/13/2023. Ricky’S Maintains A Used Oil And Material Processing Facility Permit With The Department Dated 09/23/2022, And Supplemental Submissions Dated 01/17/2023 And 01/19/2023 Expiring On 11/25/2027 (Permit Number 61835-010-Ho; 61835-011-So).
