The Facility Was Given 30 Days To Return To Compliance. | Cemex Miami Cement Mill & Scl Quarry (Cemex) Is A Permitted Used Oil Processor, Permit Number 56307-H0-004, Expires On February 12, 2013. Thermal Treatment Of Petroleum-Contaminated Soil Is The Facility'S Main Permitted Activity. Cemex Is Also A Registered Used Oil Filter Transporter And Used Oil Filter Processor; However, This Activity Is Not Taking Place At This Time. The Permitted Activities Are Situated On 300 Acres Of Land And There Is Additional Contiguous 3000 Acres Designated For Limestone Quarrying. Cemex Was Formally Known As Rinker Materials Of Florida, Inc. From 1958 Through April 2009, And Employs Approximately 100 People. The Facility Is Currently On Septic Tanks And A Well. Compliance History The Last Inspection Conducted On February 21, 2008, Revealed Several Minor Violations At The Facility. On April 15, 2008, The Facility Returned To Compliance Without Formal Enforcement | Terminal Garage In The Terminal Garage, It Was Noted That A Container Of Used Oil Was Improperly Labeled As "Waste Oil" Instead Of "Used Oil". The Mislabeled Container Also Had Some Used Oil And Debris Sitting On The Top Of The Drum Which Would Indicate Poor Housekeeping. Also, In This Area, There Was A Used Oil Filter Drum Open And Exposed To The Elements. Scl Quarry Shop This Shop Originally Consisted Of Canopy Covered Work Area; However, The Hurricanes Of 2004 And 2005 Left It Without A Roof, And Repairs Have Never Been Completed. In This Area, Inspectors Noted Several Containers Were Improperly Labeled "Waste Oil" Instead Of "Used Oil". And Although The Drums Were Afforded Secondary Containment, They Were Not Properly Sealed Allowing For The Collection Of Oily Rainwater And The Potential For Discharges. Main Warehouse The Facility Stores Their Universal Was Lamps Here. It Was Noted That The Storage Container Was Not Properly Labeled. Drum Process Building Inspection Of This Area Revealed A Container Of Used Oil Filters, Which Was Not Protected From The Elements Allowing For Collection Of Oily Rainwater And The Potential For Discharges. Kiln Feed Tank Containers Under The Sample Spigots Were Improperly Mislabeled 'Waste Oil" Instead Of "Used Oil". Heavy Equipment Shop Drums That Contained Used Oil Were Not Properly Labeled. Record Review During The Record Review, The Facility Was Unable To Provide Manifests From The Date Of The Last Inspection To The Present. The Facility'S Contingency Plan Had Deficiencies; The Home Addresses Of The Emergency Coordinator'S Were Not Included, And The Phone Numbers For The Local Police And Fire Station And Hospital Were Not Provided. 12/19/2011 Site Inspection Routine; CESQG (<100 kg/month) - Routine; Used Oil Generator - Routine; Used Oil Processor - Routine; VSQG (<100 kg/month) On December 19, 2011, Representatives Of The Florida Department Of Environmental Protection (Fdep) Conducted A Hazardous Waste And Used Oil Compliance Evaluation Inspection At Cemex Llc - Miami Cement Mill (Cemex) And Its Associated Sql Quarry. Cemex Was Represented By Mr. Charles Walz, Environmental Manager And Mr. Arthur (Joel) Eite, Plant Manager. Fdep-Sed Was Represented By Mr. Roger Carman And Mr. Kyle Brown. Cemex Is A Permitted Used Oil Processor Operating Under Permit Number 56307-H0-003, Which Will Expire On February 12, 2013. Thermal Treatment Of Petroleum-Contaminated Soil Is Another Permitted Activity. Cemex Is Also A Registered Used Oil Filter Transporter And Used Oil Filter Processor; However, These Activities Are Not Taking Place At This Time. Cemex Has Also Notified The Department As A Conditionally Exempt Small Quantity Generator Of Hazardous Waste And As An Off-Specification Used Oil Burner. The Permitted Activities Are Situated On 300 Acres Of Land And There Is Additional Contiguous 3,000 Acres Designated For Limestone Quarrying. Cemex Was Formally Known As Rinker Materials Of Florida, Inc. From 1958 Through April 2009, And Employs Approximately 100 People. The Facility Currently Uses Septic Tanks And Uses Onsite Water Wells As Sources For Industrial And Treated Potable Water Supplies. Compliance History The Last Inspection Conducted On July 15, 2010, Revealed Several Minor Violations At The Facility. On October 8, 2010, The Department Notified Cemex That It Appeared The Facility Had Returned To Compliance Based On The Information Submitted. No Formal Enforcement Was Required By The Department To Achieve Compliance. | Cemex Primarily Receives On-Specification Used Oil, But Occasionally Receives Some Off-Specification Used Oil. The Off-Spec Used Oil Has A Flashpoint Less Than 100 Degrees F Due To Mixing With Diesel Fuel At Off-Site Suppliers. Used Oil Is Burned During Kiln Startups To Preheat The Kiln To 1900 Degrees F And May Also Be Burned As Supplemental Fuel, Such As During Coal Mill Problems. Some Used Oil Is Used As Fuel For The Contaminated Soil Thermal Treatment Kiln. Used Oil Storage Tank Farm And Unloading Station This Area Consists Of Two 600,000-Gallon Aboveground Used Oil Storage Tanks, A Tanker Truck Unloading Station, And Six 25,000-Gallon Aboveground Oily Water Storage Tanks That Are Inactive. All Tanks Were Labeled "Used Oil". Used Oil Is Unloaded From Trucks And Transferred Via Pumps To The Tanks. Used Oil Pump Filter Residue Is Mixed With The Contaminated Soil For Processing. Oily Water From The Truck Unloading Containment Area Is Removed By Cliff Berry, Inc. (Cbi). Kiln Feed Tank The Kiln Feed Tank (Day Tank) Is A 30,000-Gallon Horizontal Steel Tank Used To Store Used Oil Fuel For The Kiln. It Was Labeled "Used Oil" And Lies Within A Covered, Concrete Secondary Containment Area. A Small Container Under A Pipeline Filter Was Labeled As 'Waste Oil" Instead Of "Used Oil". This Area Also Had One 55-Sallon Drum Of Used Oil, One 55-Gallon Drum Of Oily Rags And Four 5-Gallon Used Oil Collection Containers. A Safety-Kleen Parts Washer Is Located Within The Secondary Containment Area And Is Seldom Used. Any Oily Water That Collects In This Secondary Containment Area Is Removed By Cbi. The Inspectors Observed Used Oil That Had Been Absorbed With Oil Dry Material Under The Tank. Based On Information Provided By Cemex In An Email Dated 02/22/2012, The Spilled Used Oil Was Caused By A Leak In The Used Oil Recirculation Pipeline Above The Kiln Tank, And The Leak Will Be Repaired During The Next Kiln Shutdown In March 2012. New Oil Drum Storage And Equipment Wash Area This Area Had One 55-Gallon Drum Of Used Oil Filters, One 55-Gallon Drum Of Empty Aerosol Cans, One 55-Gallon Drum Of Oily Rags, One 55-Gallon Drum Of Empty Grease Canisters, And Seven 300-Gallon Plastic Totes Of Used Oil. All Containers Were Properly Labeled. This Area Also Has An Equipment Was

Thermal Treatment Of Petroleum-Contaminated Soil Is The Facility'S Main Permitted Activity. Cemex Is Also A Registered Used Oil Filter Transporter And Used Oil Filter Processor; However, This Activity Is Not Taking Place At This Time. The Permitted Activities Are Situated On 300 Acres Of Land And There Is Additional Contiguous 3000 Acres Designated For Limestone Quarrying. The Facility Is Currently On Septic Tanks And A Well; However, The Facility Is In The Process Of Connecting To The County'S Utility System. Compliance History This Visit Was A Routine Compliance Evaluation Inspection; The District Is Obligated To Inspect Each Of Their Used Oil Processors At Least Every Other Year. Cemex Is Permitted Because Of The Amount Of Used Oil That Is Stored On Site. The Last Inspection Was Conducted On December 19, 2011 And Revealed Several Minor Violations At The Facility. On February 22, 2012, The Facility Returned To Compliance Without Formal Enforcement | The Facility Was Not In Compliance At The Time Of The Inspection And Was Given 21 Days To Return To Compliance. | The Facility Tour Only Revealed A Few Small Compliance Issues. The First Issue Noted Concerned A Drum Of Used Oil Situated Underneath The Used Oil Tank For The Kiln. It Was An Open Top 55-Gallon Drum Labeled "Used Oil" Which Was Not Properly Closed As The Ring Around The Top Was Not Fastened. This Could Have Resulted In An Accidental Spill; However, The Impact Would Be Minimal, As The Drum Was Situated Within The Secondary Containment For The Large Used Oil Tank. In The Equipment Wash Area Were Several Drums For Oily Rags And Used Oil Filters That Had Appropriate Labels On Them But Also Had Older Labels Visible Indicating That The Containers Held Different Contents. Located In The Quarry Maintenance Area Were Several Drain Pans With Used Oil In Them And One 55-Gallon Drum That Were All Labeled "Waste Oil." The Last Issue That Was Encountered During The Actual Facility Inspection Was Noted In The Hazardous Waste Storage Area. The Only Drum That Was In This Area Didn'T Have The Facility'S Epa Id Number In The Appropriate Area On The Label. Record Review There Were A Few Recordkeeping Issues Noted During This Inspection. The First Concerned The Disposition Of Their Mercury Containing Lamps. The Facility Was Having Them Picked Up By Vieola But Couldn'T Produce Certificates Of Recycling At The Time Of The Inspection. The Facility Could Not Prove That The Latest Revision Of Its Contingency Plan Had Been Distributed To Local Authorities. The Department'S Contacts On Their Emergency Response Contact List Had Not Been Updated Since The Department'S Reorganization And The Department'S Address Also Needed To Be Updated. The Inspector Supplied The Facility With The Address Correction And Promised To Forward The New Organizational Chart Upon Their Return To The Office. All Other Records Appeared To Be In Order: Training Records, Manifests, Used Oil Delivery Logs, And The General Facility Inspection Log. | This Was A Pretty Routine Inspection With Only Minor Issue, Tried To Keep The Report To A Minimum. Used Oil Is The Main Fuel Used For Firing The Cement Kiln But The Facility Is Also Using Wood And Tire Fluff, As Fuel Alternatives. The Facility Already Has Natural Gas Lines Hooked Up At The Plant But They Haven'T Been Connected To Kiln Due To Initial Installation Cost. Cemex Is Also A Registered Used Oil Filter Transporter And Used Oil Filter Processor; However, This Activity Is Not Taking Place At This Time. The Permitted Activities Are Situated On 300 Acres Of Land And There Is Additional Contiguous 3000 Acres Designated For Limestone Quarrying. Cemex Employs Approximately 100 People And Is Connected To County Water And Septic Tanks. Compliance History This Visit Was A Routine Compliance Evaluation Inspection; The District Is Obligated To Inspect Each Of Their Used Oil Processors At Least Every Other Year. Cemex Is Permitted Because Of The Amount Of Used Oil That Is Stored Onsite. The Last Two Inspections Were Conducted On December 19, 2011 And March 20, 2013, Respectively. Each Of These Inspections Revealed Only Minor Violations And In Each Case, The Facility Return To Compliance Without Enforcement. | The Facility Was Not In Compliance At The Time Of The Inspection And Was Given 14 Days To Return To Compliance. On March 10, 2015, The Department Received A Compliance Submittal From Cemex That Provided Documentation Demonstrating The Facility Had Returned To Compliance From The Issues That Were Noted During The February 24, 2015 Inspection. | The Facility Tour Only Revealed Two Small Compliance Issues. Out At The Facility'S Maintenance Shop, That Is Associated With The Quarry, There Was A Pallet Of Batteries That Was Sitting Out In The Open And Unprotected From The Elements. The Other Issue Was Related To The Laboratory Waste That Is Created Onsite. It Is Stored In A Three Sided Concrete Enclosure With A Roof Which Has An Entrance Consisting Of A Locked Chain Link Fence. Since The Facility Representative Didn'T Have A Key To The Enclosure With Him, The Drum Was Observed Through The Fence. From That Vantage Point, It Appeared That The Drum Was Not Properly Closed And A Funnel Had Been Left In The Bung Hole. Record Review There Was Only One Recordkeeping Issue Noted. The Facility Had Recently Purchased An Aerosol Can Puncturer And Was Combining The Waste Paints And Solvents From Their Aerosols Cans To Be Shipped Offsite As Hazardous Waste. They Were Also Collecting The Empty Cans For Metal Recycling. However; The Facility Couldn'T Produce Any Documents From The Last Three Years To Account For The Shipment Of "Non-Rcra Empty" Aerosol Cans As Hazardous Waste Prior To The Purchase Of The Puncturer. During The Inspection, Cemex Was Represented By Mrs. Maria Rodriguez, Assistant Site Manager Of The Facility. The Dep Was Represented By Norva Blandin, Kayla Acosta And Daniel Lopez, Environmental Specialists. Notification History 2/9/2017- Notified As Used Oil Burner, Used Oil Processor, A Cesqg And Small Quantity Handler Of Universal Waste. This Registration Will Expire On 6/30/2018. Inspection History 2/24/2015 - Fdep Inspection. Minor Oc- One Violation Was Cited And Returned To Compliance Without Enforcement (Cwoe). Ppe Was Required By The Facility (Hard Hats, Gloves, Safety Vest, Safety Glasses, Safety Boots And Ear Protection) And Also A Brief Safety Training Was Conducted By Mrs. Rodriguez Prior To Entry The Facility. | Cemex Primarily Receives On-Specification Used Oil, But Occasionally Receives Some Off-Specification Used Oil. Scl Quarry Shop The Sql Quarry Provides Crushed Limestone To Cemex And Is Covered Under Cemex'S Epa Identification Number Fld981758485. This Quarry Shop Had A Canopy Covered Work Area; The Used Oil Storage Area Has Been Provided With A Metal Roof. The Inspectors Observed The Some Oily Rain Water Had Accumulated In The Secondary Containment Area Of The 500-Gallon Used Oil Tank. Containers Of Used Oil Filters And Oily Rags Were Protected From The Elements, Properly Labeled And Stored On Containment Pallets. No Hazardous Waste Is Generated At This Shop. Spill Kits And Fire Extinguishers Were Observed During The Inspection. Used Oil Storage Tank Farm And Unloading Station This Area Consists Of Two 600,000-Gallon Aboveground Used Oil Storage Tanks, A Tanker Truck Unloading Station, And Six 25,000-Gallon Aboveground Oily Water Storage Tanks That Are Inactive. Used Oil Is The Main Fuel Used For Firing The Cement Kiln; However, The Facility Is Authorized To Use Tire Fluff As An Alternative Fuel. The Facility Already Has Natural Gas Lines Hooked Up At The Plant But They Haven'T Been Connected To Kiln Due To Initial Installation Cost. Cemex Is Also A Registered Used Oil Filter Transporter And Used Oil Filter Processor; However, This Activity Is Not Taking Place At This Time. Ppe Was Required By The Facility (Hard Hats, Gloves, Safety Vest, Safety Glasses, Safety Boots And Ear Protection) And Also A Brief Safety Training Was Conducted By Mrs. Rodriguez Prior To Entry The Facility. | Cemex Primarily Receives On-Specification Used Oil, But Occasionally Receives Some Off-Specification Used Oil. The Off-Spec Used Oil Has A Flashpoint Less Than 100 Degrees F Due To Mixing With Diesel Fuel At Off-Site Suppliers. Used Oil Is Burned During Kiln Startups To Preheat The Kiln To 1900 Degrees F And May Also Be Burned As Supplemental Fuel, Such As During Coal Mill Problems. The Inspectors Toured The Facility With Cemex Representative Through The Following Areas: Aggregates Plant-Scl Quarry Shop, Used Oil Storage Tank Farm And Unloading Station, Mechanic Shop/Maintenance Warehouse,New Oil Drum Storage/Equipment Wash Area, Qc Laboratory And Hazardous Waste Storage Area (Vsqg Amounts). Scl Quarry Shop The Scl Quarry Provides Crushed Limestone To Cemex And Is Covered Under Cemex'S Epa Identification Number Fld981758485. This Quarry Shop Has A Canopy Covered Work Area; The Used Oil Storage Area Has Been Provided With A Metal Roof. The Inspectors Observed That The Secondary Containment Area Of The 500-Gallon Used Oil Tank Was Clean And Free Of Debris. The Following Containers Were Observed: > Four (4) 55 Gallon Metal Drums Of Used Oil Filters > One (1) 55 Gallon Metal Drum Of Oily Rags > Two (2) 30 Gallon Metal Buckets Of Used Oil All Containers Described Above Were Protected From The Elements, Properly Closed, Labeled And Stored On Containment Pallets. No Hazardous Waste Is Generated At This Shop. Spill Kits And Fire Extinguishers Were Observed During The Inspection. Used Oil Storage Tank Farm And Unloading Station This Area Consists Of Two (2) 600,000-Gallon Above Ground Used Oil Storage Tanks (Ast'S), A Tanker Truck Unloading Station, And Six (6) 25,000-Gallon Above Ground Oily Water Storage Tanks That Are Inactive. Cemex Was Inspected To Determine The Facility Compliance With The State And Federal Hazardous Waste Regulations Described In Title 40, Code Of Federal Regulations (Cfr) Parts 260-268, 273, And 279, Adopted And Incorporated By Reference In Rule 62-710, 62-730, And Rule 62-737, Florida Administrative Code (Fac). The Inspector Was Escorted Around The Facility By Roger Hogg, Environmental Manager. Upon Arrival At The Facility, The Inspector Presented Their Credentials And Explained The Purpose Of The Inspection. The Permitted Activities Occur In 300 Acres And There Is Additional Contiguous 3,000 Acres Of Land Designated For Limestone Quarrying. The Facility Has Been In Operation At This Site Since 1958, Employs 117 Staff, And It Is Connected To The County Water, Sewer Services And Septic Tanks. The Facility’S Hours Of Operation Are 24 Hours Per Seven Days A Week. Notification History: Cemex Most Recently Renotify The Department On 03/24/2020 As Used Oil Burner, Used Oil Processor (Permit Expiration On 04/26/2023) And As Very Small Quantity Generator (Vsqg). The Facility Is Currently Registered Under The Storage Tanks Program Under The Facility Id #8521974 And Operates Under A Clean Air Act Title V Operating Permit (Permit No. 0250014-068-Av) That Expires On 12/15/2021. Inspection History: The Facility Was Lastly Inspected By The Department On 04/25/2019. During The Inspection, It Was Found To Be Out Of Compliance For Failure To Keep A Hazardous Waste Container Closed, Failure To Label A Used Oil Container, And Failure To Properly Maintain A Secondary Containment. The Facility Returned To Compliance On 05/08/2019 And The Case Was Closed As Compliance Without Enforcement (Cwoe). In The Previous Cei On 11/8/2017 The Facility Was Found To Be In Compliance. Personal Protective Equipment (Ppe) Was Required To Enter The Facility. Department Personnel Were Equipped With Steel-Toed Boots And A Facial Mask. | Cemex Is A Portland Cement Plant That Burns On-Spec Used Oil For Kiln Startups And Fuel Supplement. The Wastes Generated From These Processes Include, But Are Not Limited To Spent Alcohol (Glycerol), Which Exhibit A Toxicity Characteristic For Ignitability (Epa Waste Code D001) And Used Oil, Used Oil Filters, Oily Absorbents And Oily Water. Additionally, Spent Mercury Lamps, Exhibiting A Hazardous Waste Characteristic Of Toxicity For Mercury (Epa Waste Code D009); Spent Lead Acid Batteries, Exhibiting A Hazardous Waste Characteristic Of Toxicity For Lead (Epa Waste Code D005), And Spent Aerosol Cans, Exhibiting A Hazardous Waste Characteristic Of Ignitability (Epa Waste Code D001), All Of Which Are Considered Hazardous Unless Managed Under The Universal Waste Regulations. The Wastes Are Generated At The Transport Shop, Pump Building, Cement Plant, Drum Building, Repair Shop, Quality Control (Qc) Lab And Quarry Shop. Transport Shop It Is Where Cemex Fleet Is Maintained And Repaired, This Area Is Managed By A Contractor. In This Area The Inspector Observed: >One Open 15-Gallon Metal Container Of Parts Washer In Use. The Facility Disposes Of The Spent Solvents As Non-Hazardous. The Department Requested Documentation That Supports This Waste Determination. > One Water Filtration System Tank That Collects Wastewater From The Truck’S Wash Station. This Tank System Was Observed Overflown With Which Appeared To Be Oily Water. The Facility Was Required To Conduct A Waste Determination In This Wastewater, Per 40 Cfr 262.11. >Two Closed 55-Gallon Poly Drums Of Used Oil Missing A Label.
