Routine; Used Oil Transfer Facility An Announced Inspection Was Conducted At January Environmental Services To Determine The Facility'S Compliance With Used Oil Transporter And Transfer Facility Regulations. The Company Has One Driver That Works Out Of This Location, Although At Times Other Drivers Pick Up Or Deliver Materials To The Facility. There Are No Full Time Office Employees. Loren January And Cruz Torres Represented The Company During The Inspection. | January Is A Used Oil, Used Oil Filter And Oily Waste Water Transporter. The Facility Picks Up Waste From Its Customers, Consolidates It And Arranges For Final Treatment And Disposal. Facility Operations Have Changed Since The Previous Inspections. The Facility Is Now Managing Drums Of Used Antifreeze And Some Other Drummed Waste In Addition To The Old Grease That Was Managed Previously. These Were Being Stored Within A Bay Inside The Facility. At The Time Of The Inspection, A Drum Labeled "Parts Washer Sludge" And A Drum Of Used Antifreeze Were In Storage. These Had Been Accepted From Wal Mart Distribution Center #7038 In Ft. Pierce On November 29, 2010. The Shipping Paper Includes A Generator Certification Statement Section Regarding The Nature Of The Waste. However The Shipping Paper Was Not Signed By The Customer In That Area. The Facility Is A Small Quantity Generator, Not A Cesqg, According To The Notification Forms Filed By Wal-Mart In 2006 And Again In December 2010. In Addition, Two 20 Gallon Containers Holding Parts Washing Solvent Were On Site That Were Generated By Great Wide, The Vehicle Maintenance Contractor Operating At Wal Mart Distribution Center #7023 In Desoto County. This Distribution Center Has Also Notified As A Small Quantity Generator. This Material Had Been Accepted For Transportation On November 1, 2010. The Certification Statement Had Been Signed On The Shipping Paper For This Waste. The Generator'S Epa Identification Number Was Not Included On Either Of These Shipping Papers. January Environmental Does Not Have A Solid Waste Permit Or A Used Oil Permit Authorizing Acceptance Of Drummed Wastes. In Addition, The Department Is Concerned That These Wastes Have Been Accepted Without Adequate Waste Characterizations.
The Bay Also Held A Drum Collecting Used Oil Samples That Was Located Next To A Roll Up Door. Either Secondary Containment Must Be Provided, Or The Drum Must Be Moved To A Location That Will Contain Releases. The Bay Also Held Empty Drums, Several Full Drums Of Waste Grease, Along With Containers Of Used Absorbent. Ms. January Was Requested To Provide Additional Information On The Management Of Drummed Wastes By The Facility.
Used Antifreeze Is Also Managed In One Of The Facility'S 20,000 Gallon Storage Tanks. Cruz Torres Said That The Antifreeze Was Being Disposed Of To January'S Nashville Tn Facility. The Only Shipping Records For Waste From Bartow To Nashville Were For Tanker Loads Identified As ~3,500 Gallons Of Used Oil. Florida Does Not Include Waste Antifreeze Within Its Definition Of Used Oil, And Spent Antifreeze Is Not Exempt From Regulation As Hazardous Waste If Burned. In A Letter Dated January 13, 2011, Ms. January Said That Nashville Was Reclaiming The Antifreeze, Which Is An Exempt Activity In Florida. However January'S Web Site States That The Nashville Facility Recovers Organics Which Are Then Fuel Blended. Further Clarification Is Being Sought On This Issue.
Three Tanks Were Being Used To Hold Used Oil At The Time Of The Inspection. One Of The Tanks, With ~17,500 Gallons Of Oil Was Being Loaded Into A Rail Car. The Rail Car Was Provided With Track Pans That Drained To A Concrete Sump With A Sump Pump For Secondary Containment. January Began Shipping By Rail On March 11, 2009. Ms. January Said That They Began Loading A Rail Car Beginning When Oil Had Been Stored In The Tank Farm For 30 Days. Routine; CESQG (<100 kg/month) - Routine; VSQG (<100 kg/month) - Routine; Used Oil-Other An Announced Inspection Was Conducted At January Environmental Services On February 20, 2015 To Determine The Facility'S Compliance With Used Oil Transporter And Transfer Facility Rules And To Investigate A Complaint. Lynn Harris Represented The Company During The Inspection. A Follow-Up Visit Was Conducted On February 25, 2015. Loren January Was Available At This Time For The Paperwork Review And To Answer Additional Questions. | The Complaint Alleged That The Facility Had Covered An Oil Spill Rather Than Cleaning It Up. The Inspection Determined That There Had Been A Small Spill Caused By An Equipment Malfunction. The Contaminated Dirt Had Been Excavated For Proper Disposal, And The Hole Had Been Filled With Clean Sand. There Was No Evidence Of Contamination At The Facility.
January Currently Has Two Drivers. A Third Driver And A Process Operator Had Been Fired The Previous Week. At The Time Of This Inspection, All The Company Vehicles Operating Out Of This Location Appeared To Be On Site. The Vac Trucks Holding Used Oil Were Not Parked Within Secondary Containment. One Of These Had Been Parked On Site For More Than 24 Hours Due To Staff Changes, But Was Scheduled To Be Emptied That Day. A Compartmented Tank Trailer Was Parked On The East Side Of The Facility. Mr. Harris Said That The Trailer Was Used To Transport Oily Waste Water, And Was Currently Empty.
In Addition, An Empty Baker Tank And Empty Roll Off Container Were Parked On Site. The Loading Rack Had A Parked Tanker, A Portable Un Tank And Two Rail Cars. The Facility Currently Has A Track Pan Only Under The Rail Car Loading Area. Full Rail Cars Are Not Provided With Containment. Rail Cars May Take More Than 24 Hours To Load Or Unload.
At This Time, January Is Mainly Processing Oily Water And Bilge Waste. Mr. Harris Initially Said That Oil Was Being Brought In By Rail, But Then Later Also Said That The Rail Cars Were Used To Ship Water Separated From The Oil. The Un Tank Is Used To Bring In Waste From Ships At The Port. At This Time January Has Not Shipped Via Rail In The Last Few Years. There Is Currently Waste Water Being Stored In The Rail Cars Which Was Analyzed In January 2015.
Mr. Harris Said That The Oil Recovered From Processing Was Tested For Water Content, Solids Content And Ash Content. No Chemical Testing Is Done On The Oil For Sulfur, Btu Content Or Any Of The Used Oil Specifications. In Addition, Mr. Harris Said That The Incoming Material Was Not Being Tested To His Knowledge. No Dexil Test Kits Were On Site. He Identified The Incoming Material As Number 6 Oil.
Oily Waste That Is Received Is Pumped Into One Of Six Holding Tanks. A New Green Tank Has Been Installed In A Separate Containment Area Attached To The Existing Containment. At The Time Of The Inspection This Tank Was Empty, And A Second Green Tank Was In The Yard, On Its Side. The Facility Is Reminded That If They Plan To Use This Tank To Store Regulated Materials They Must Comply With All Regulatory Requirements. Regulated Tanks Are Required To Be Registered 30 Days Prior To Installation, Or Within 30 Day Of Changing From A Waste Water Or Process Tank To A Regulated Used Oil Storage Tank. In Addition, A Permit Modification May Be Needed If Storage Or Procession Capacity Is Increased. At The Time Of The Inspection The Containment Around The Tank Farm Was In Good Repair, Did Not Contain Any Free Liquids, And Appeared To Be Adequate To Contain The Volume Of The Tanks.
From The Holding Tanks, The Oil Is Pumped Into One Of Two Processing Tanks, Where It Is Heated And Chemicals Are Added To Help Gravimetric Separation And De-Emulsification. Acid And Caustic Are Available On Site For Ph Adjustment. The Facility Was Originally Notified As A Small Quantity Generator On March 25, 1988, Under The Name Ashland Chemical Company. The 5.18-Acre Property Was Sold To January Environmental On October 20, 2004 And The Notification Was Changed To Used Oil Transporter, Transfer Facility, Marketer And Filter Transporter. The Company Obtained A Used Oil Processor Permit (307171-Ho-001) On April 16, 2012 Due To Problems Related To Storing Collected Oil More Than 35 Days. The Permit Expired April 16, 2017, And January Failed To Timely File An Application To Renew The Permit. The Department Has Conducted A Number Of Hazardous Waste Inspections Of This Facility, Most Recently On February 20, 2015. Cruz Torres Accompanied The Inspectors During The Facility Inspection Conducted On May 23, 2017. A Follow-Up Visit Was Conducted On May 31, 2017; Loren January Was Available During The Second Site Visit For The Paperwork Review And To Answer Additional Questions. | January Is A Used Oil, Used Oil Filter And Oily Waste Transporter And Processor. The Facility Does Not Have Full Time Office Employees And There Are Currently Two Drivers That Work Out Of This Location. The Facility Picks Up Waste Products From Its Customers, Consolidates And Stores The Waste And Arranges For Final Treatment And Disposal. January Does Not Accept Used Oil Or Oily Water From Other Transporters, Except For One Company That Was Required To Notify As A Transporter As It Transports More Than 55 Gallons Of Self-Generated Oil At A Time. The Facility Does Not Collect Public Used Oil.
During The Last Inspection Of The Facility Conducted On February 20, 2015, Is Was Discovered That January Was Processing Used Oil Through The Use Of A Centrifuge And A Vibratory Screen Filter. As This Was Not Authorized In The Permit, January Was Required To Submit An Application For A Major Permit Modification. Submittals Were Received On October 15, 2015, November 12, 2015 And November 17, 2015. The Major Permit Modification Was Approved By The Department On February 11, 2016. The Facility Was Required To Submit An Application For Permit Renewal By February 16, 2017; However, The Application Was Not Received Until April 13, 2017. The Department Issued A Request For Additional Information (Rai) On April 21, 2017; A Response Was Due By May 22, 2017; However, An Extension Was Granted Until July 3, 2017.
The Facility Is No Longer Processing The Used Oil It Receives From Customers And Has Not Been For The Past Several Months. During This Inspection, The Centrifuge Had Been Removed From The Treatment System And Per Mr. Torres, Will Be Sent To January’S Oklahoma Facility.
At The Time Of This Inspection, Two Of The Company Vehicle Operating Out Of This Location Were Present Onsite. A Wastewater Truck Was Located Next To The Building. Used Oil Truck #15, Which Was Empty At The Time Of The Inspection, Was Located At The Rail Car Loading Rack. Per Mr. Torres, January Uses Tif Xl-1a Meters To Screen Used Oil For Halogen Content Prior To Accepting The Used Oil From Their Customers. At The Time Of The Inspection, Neither A Tif Instrument Nor A Dexsil Test Kit Was Present In Used Oil Truck #15.
In Addition To Used Oil Truck #15, One Rail Car Was Located At The Loading Rack. A Track Pan Is Located Under The Rail Car Loading Area. The Facility Is Not Currently Receiving Or Shipping Used Oil Via Rail. The Rail Car Contained Used Oil Solids As The Liquids From This Vessel Had Been Placed Into Tanker Trailer T-43. January Is In The Process Of Getting The Solids Removed From This Railcar. The Railcar Will Be Re-Certified And Will Then Be Sent To January’S Facility In Oklahoma. A Second Railcar, Which Was Empty, Was Sent To January’S Oklahoma Facility Within The Past Few Months.

Based On This, The Department Issued A Letter To January On August 23, 2018, Notifying Them That They Were No Longer Authorized To Transport, Or Market Used Oil, Or Used Oil Filters. Additionally, The 2019-2020 Used Oil Transporter/Used Oil Filter Registration Has Not Been Submitted By March 1, 2019 As Required. The Most Recent Certificate Of Liability Insurance, Effective From January 25, 2019 Through January 25, 2020, Was Submitted To The Department On February 20, 2019. The Annual Report By Used Oil And Used Filter Handlers Was Not Submitted By March 1, 2018, For 2017; Nor Has The Annual Report By Used Oil And Used Filter Handlers Was Not Submitted By March 1, 2019, For 2018.
The Facility Does Not Have Full Time Office Employees; Mrs. Dorwart Provides Administrative Services As Needed. For The Past Several Years, Two Drivers Work From This Location (Leandro Torres And Cruz Torres). The Facility Picks Up Waste Products From Its Customers. Wastewater Is Not Brought Back To The Facility But Transported Directly To Aqua Clean Environmental Company (Epa Id #Flr000193466) For Processing. Used Oil, Oily Water And Used Oil Filters Are Consolidated And Stored On-Site Prior To Transportation For Final Treatment And Disposal. Mrs. Dorwart Stated That The Used Oil Side Of The Business At This Location Has Been Much Reduced As January Lost A Customer That Was Responsible For Most Of Their Used Oil Volume. January Does Not Accept Used Oil Or Oily Water From Other Transporters. The Facility Does Not Collect Public Used Oil. While January Was Processing Used Oil Using A Centrifuge And A Vibratory Screen In The Past, All Processing Equipment Was Removed From The Facility In The Spring Of 2017.
At The Time Of This Inspection, The Facility’S Wastewater Truck Was On The Road And Used Oil Truck #15 Was Parked Next To The Rail Car Loading Rack On The North Side Of The Facility. The Tif Xl-1a Meter, Which Usually Kept In Used Oil Truck #15, Was Available For Inspection In The Facility’S Laboratory. The Meter Is Used To Screen Used Oil For Halogen Content Prior To Accepting The Used Oil From Their Customers. Tanker Trailer #113, Which Was Empty, Was Located On The East Side Of The Main Building. No Rail Cars Were On-Site At The Time Of The Inspection. According To Mrs. Dorwart, The Most Recent Rail Shipment Was For 20,000-Gallons Of Used Oil On January 3, 2019.

Loren Dorwart, Manager, Accompanied The Inspectors During The Inspection. | The Facility Was Not In Compliance With State And Federal Used Oil/Used Oil Filter Transfer, Transporter And Processor Regulations At The Time Of The Inspection. | January Is A Used Oil, Used Oil Filter And Oily Waste Transporter And Storage Facility And A Wastewater Transporter. The 5.18-Acre Property Was Purchased By January Transport, Inc., On October 20, 2004. The Facility Consists Of A 5,414 Square Foot Building Which Houses Offices, A Laboratory And Warehouse, A Used Oil Tank Farm, And A Rail Spur. The Facility Does Not Have Full Time Office Employees; Mrs. Dorwart Provides Administrative Services As Needed. Currently, One Driver Works From This Location (Cruz Torres). The Facility Is Open From 8 A.M. To 5 P.M., Monday Through Friday. The City Of Bartow Provides Sewer And Potable Water Services. The Facility’S Fire Extinguishers Were Last Certified In June Of 2020, In Addition The Facility Has Pull Fire Alarms And First Aid Kits Were Present.
The Company’S Current Used Oil Processor Permit (307171-Ho-004) Was Issued On December 7, 2017 And Expires On December 7, 2022. The Used Oil Processor Permit Allows Used Oil To Be Stored Oil On Site For More Than 35 Days. The Facility Is Not Currently Processing The Used Oil Received From Customers And Has Not Been Since 2017.
The 2020-2021 Used Oil Transporter/Transfer Facility And Used Oil Filter Transporter/Transfer Facility Registration (Proof Of Insurance, Renotification Using Form 8700 And Registration Fees) Were Due By March 1, 2020. Proof Of Insurance (Effective From January 25, 2020 Through January 25, 2021), Renotification And Registration Fees Were Not Received Until January 4, 2021 And The 2020-2021 Used Oil Transporter/Used Oil Filter Registration Was Issued On January 20, 2021. As Such, The Facility Operated As A Used Oil And Used Oil Filter Transporter And Transfer Facility Without The Required Registration From July 1, 2020 Through January 19, 2021. The Facility Picks Up Waste Products (Wastewater, Used Oil And Used Oil Filters) From Its Customers. In The Past, Used Oil And Used Oil Filter Transportation And Storage Made Up The Majority Of January’S Business, However Over The Past Few Years This Side Of The Business Has Tapered Off Significantly. Used Oil Collected From Customers In The Used Oil Truck Or Tanker Trailers Is Pumped Into The Used Oil Aboveground Storage Tanks (Asts) Using The Overhead Used Oil Loading Rack Adjacent To The Railroad Spur. Used Oil Brought Back To The Facility In Smaller Containers Is Also Pumped Into The Used Oil Asts.
