07/07/2010 Site Inspection Routine; Hazardous Waste Transporter - Routine; Used Oil Transporter - Routine; Universal Waste Transporter American Compliance Technologies, Inc. (Act) Was Inspected On July 7, 2010 To Determine The Facility'S Compliance With State And Federal Hazardous Waste Regulations. Ms. Wortman Accompanied The Inspector Throughout The Inspection. The Department'S Hazardous Waste Section Last Inspected This Facility In 2004. | Act Is Primarily An Emergency Response Company, But Offers A Variety Of Environmental Services. This Facility Is Registered With The Department As A Used Oil, Used Oil Filter And Universal Waste Transporter And Transfer Facility As Well As A Hazardous Waste Transporter. The Facility Consists Of A Main Office Building And Two Warehouse Buildings. One Of The Warehouse Buildings (#2) Also Serves As Their Permitted Solid Waste Processing Building. At The Time Of The Inspection, The Facility Was Not Storing Any Transported Used Oil Or Used Oil Filters On Site. However, The Facility Did Have Multiple Containers Storing Universal Waste, All Of Which Were Properly Closed And Labeled. This Building Also Houses Some Tanks Inside And A Tank Farm Outside The Western Side Of The Building. These Tanks Fall Under The Department'S Solid Waste Permit And Were All Empty At The Time Of The Inspection. Act Conducts Routine Maintenance On Their Own Vehicles And Equipment Within Warehouse #1. At The Time Of The Inspection, The Facility Had One 55-Gallon Drum Storing Used Oil, One 55-Gallon Drum Storing Drained Used Oil Filters And One 30-Gallon Drum Collecting Spent Aerosol Cans. The Drums Were Located Well Within The Building. Act Recycles Used Oil And Used Oil Filters Through Fcc Environmental. Universal Wastes Are Picked Up By Veolia Several Times Yearly. Act Recently Began Transporting Hazardous Waste. Act Had Picked Up Only Three Shipments Of Hazardous Waste From A Facility In Jacksonville Which Were Transported To Giant Resource Recovery. Paperwork Was Inspected During The Inspection, Including Used Oil Training, Financial Assurance And Acceptance/Disposal Receipts And Manifests. No Discrepancies Or Violations Involving The Facility'S Documentation Were Observed. | At The Time Of The Inspection, American Compliance Technologies, Inc. Was Not Operating In Compliance With Used Oil Generators. Immediately Following The Inspection, The Facility Returned To Compliance. | Please Approve | Submitted For Approval By Camp, Shannon D.

01/10/2013 Site Inspection Routine; Used Oil Transfer Facility A Joint Solid Waste And Hazardous Waste Inspection Was Conducted At American Compliance Technologies (Act), A Registered Hazardous Waste Transporter And Used Oil Transfer Facility. The Solid Waste Program Report Is Being Prepared Under Separate Cover. Kelly Winter Provided Assistance During The Inspection, And Ann Wortman Provided Additional Information And Documents During Preparation Of This Report. Company Operations Have Not Changed Significantly Since The Previous Hazardous Waste Program Inspection In July, 2010. The Company Is In The Process Of Constructing A New Office Building, Which Will Be Used To Provide Training In Association With Florida Polytechnic University. | Act Offers A Variety Of Environmental Services, Including Emergency Response, Site Assessment, Sampling, Waste Brokering As Well As Transportation. The Facility Maintains Current Registrations For Used Oil And Hazardous Waste Transportation, But Transports Very Little Of These Wastes. In Most Cases, The Company Prefers To Broker Used Oil And Hazardous Waste Transportation Services. At The Time Of This Inspection, Two Containers Identified As Petroleum Contaminated Water Were The Only Potentially Rcra-Regulated Wastes Within The Storage Warehouse. Non Hazardous Investigation Derived And Spill Cleanup Wastes Are Transported And Stored Under The Facility'S Solid Waste Permit. Records Were Reviewed And Confirmed That The Company Has Transported Little Used Oil Generated From Off Site Within The Past Calendar Year, And Has Not Stored The Material For More Than 35 Days. Acceptance And Disposal Records Included All Required Information. Halogen Screening On Accepted Oil Is Conducted Using Chlor-D-Tect Q-1000 Test Kits. Training Was In Compliance. The Facility Generates A Small Amount Of Used Oil And Oil Filters Within The Maintenance Shop. Containers Managing These Items Were Stored Within Containment. The Containers Were Labeled And In Good Condition. | Based On The Results Of This Inspection, American Compliance Technologies Was In Compliance With Used Oil And Hazardous Waste Management Regulations. | Ready For Review | Ready For Review
11/05/2015 Site Inspection Routine; Used Oil Transfer Facility American Compliance Technologies, Inc. (Act) Was Inspected On November 5, 2015, To Determine The Facility’S Compliance With State And Federal Hazardous Waste Regulations. Act Is A Registered Hazardous Waste Transporter And A Used Oil Transfer Facility. Dave Manley (Operations Manager), Ashley Shive (Director Of Safety & Compliance) And Mike Mathis (Warehouse Manager) Accompanied The Department Representatives During The Inspection. Company Operations Have Not Changed Significantly Since The Previous Hazardous Waste Program Inspection In January 2013. Since The Last Inspection The Company Has Constructed A New Office Building. A Portion Of The Building Is Used To Provide Training In Association With Florida Polytechnic University. | Act Is Primarily An Emergency Response Company, But Offers A Variety Of Environmental Services Such As Site Assessment, Sampling, Waste Brokering As Well As Transportation. The Facility Is Registered With The Department As A Used Oil, Used Oil Filter And Universal Waste Transporter, Used Oil Transfer Facility And A Hazardous Waste Transporter. The Facility Utilizes Raider Environmental (Flr000176271) As A Hazardous Waste Transfer Facility As Needed. According To Dave Manley Their On-Site Wastewater Pre-Treatment System Is Still Not Operational. They Have Applied For A Permit From The City Of Bartow To Operate The System. The Facility Currently Consists Of Two Office Buildings And Two Warehouse Buildings (#1 & #2). Warehouse #1 Serves As A Maintenance Shop Where They Conduct Routine Maintenance On Their Own Vehicles, And Warehouse #2 Serves As Their Permitted Solid Waste Processing Building Along With The Inactive Wastewater Pre-Treatment System. At The Time Of The Inspection, The Inspectors Observed In Warehouse #2 A Drum Of Used Oil Filters, Three Drums Of Sludge Obtained From The Cleanup Of Used Oil Spills, And Eight Drums Of Latex Yellow Paint Liquid. All Drums Were Labeled And Closed. Spent Universal Waste Lamps Stored In Boxes Were Labeled And Closed. In Warehouse #1 A Drum Was Observed Collecting Oily Rags And Another Drum Collecting Used Oil Filters. The Drum Collecting The Oil Filters Was Not Labeled. During The Inspection The Facility Labeled The Drum And On November 19, 2015 The Facility Provided Photos Of The Properly Labeled Drum. An Aerosol Brake Cleaner Which Contained Greater Than 10% Toluene Was Observed In The Maintenance Work Area. The Warehouse Manager Indicated The Brake Cleaner Is Occasionally Used With Rags To Clean Parts. The Solvent Contaminated Rags Were Being Discarded In A Drum With Other Oily Rags, And Were Not Being Managed In Accordance With The Excluded Solvent Contaminated Wipe Rule (40 Cfr 261.4). Proper Disposal Of These Solvent Rags Was Discussed During The Inspection, Including Management Of Rags Under This Rule. According To Dave Manley The Facility Will Immediately Implement The Proper Management And Disposal Of These Solvent Contaminated Rags, As Well As Evaluating If Further Use Of Any Solvent Cleaners Are Necessary To Do The Job. Spent Lead Acid Batteries Are Returned To Either Advance Auto Parts Or Napa Auto Parts For Core Credit. Act Recycles Used Oil Through Heritage Crystal Clean And Used Oil Filters Through Petrotech Se Or Heritage Crystal Clean. Universal Waste Are Picked Up By Either Lighting Resources Or Veolia. Records Reviewed From 2013 Through 2015 Indicated That The Company Continues To Transport Small Quantities Of Used Oil Generated From Off Site, And Has Not Stored The Material For More Than 35 Days. Hazardous Waste Manifests Records Reviewed Indicate That Six Shipments Of Waste (#008759422 Jjk, 008759423 Jjk, 008759424 Jjk, 008759444 Jjk, 008759445 Jjk, 008759476 Jjk) Were Picked Up Days After The Generator Dated The Manifests. According To Ms. Shive, The Generator Had Pre-Dated The Manifests Prior To Them Picking Up The Wastes. The Inspectors Discussed That This Was An Improper Dating Of The Manifests And Act

06/29/2018 Site Inspection Routine; Transporter - Routine; CESQG (<100 kg/month) - Routine; Used Oil Transporter - Routine; VSQG (<100 kg/month) On June 29, 2018, Fdep Conducted A Routine Hazardous Waste Inspection At The Headquarters And Primary Facility Of American Compliance Technology (Act), In Bartow (Polk County). The Facility Is A Notifier As A Cesqg (Vsqg), Transporter, And Used Oil Transporter. | Act’S Bartow Facility Is A Headquarters Office, And A Storage Yard For Their Response Equipment And Vehicles. Most Work Is Done At The Customer’S Site, Not At This Facility. • Act Transports Hw, Used Oil, And Petroleum-Contact Water (Pcw) Generated During Spill Cleanups, And For Routine Waste Removal For Some Customers. The Wastes Are Transported Directly To Another Transporter Or A Permitted Tsdf, And Not Stored More Than 24 Hours At The Bartow Facility, Since The Facility Is Not A 10-Day Transfer Facility. • None Of The Hw Transport Vehicles Were On-Site At The Time Of Inspection, But Were Said To Be Well-Maintained. Act’S Vehicles Have Placards And Container Labels, To Meet Dot Requirements. • Numerous Hw Manifests Were Reviewed, And All Found To Be Correct And In Order. Each Of The Act Participants In The Inspection Have Several Years Of Prior Experience In The Hw Transportation Business, And Were Well-Versed In The Matter. • The Facility Is A Very Small Qty. Generator (Vsqg) Of Hw. Vehicle Maintenance Activities Have Greatly Curtailed, As The Vast Majority Of Vehicle Maintenance Is Now Done Off-Site At Retail Repair Businesses. Thus, The Amount Of Hw And Used Oil Has Greatly Diminished. Only An Occasional Paint Or Spray Can Waste Is Generated, Along With Small Amounts Of Universal Wastes (E.G., Batteries, Fluorescent Light Bulbs). • The Facility Has A Dep Solid Waste Permit, To Solidify Certain Non-Hazardous Waste Streams Received From Off-Site. The Wastes Are Then Transported For Non-Hazardous Waste Disposal (E.G., Landfill). Dep Solid Waste Staff Recently Conducted A Separate Routine Inspection Of This Process And Permitted-Activity. Thus, This 6/29/18 Hw Inspection Did Not Address Those Matters. • There Were No Visual Or Odor Indications Of Any Unpermitted Discharges. The Grounds And Vehicle Storage Areas Were Neat And Orderly. | American Compliance Technology (Act), Bartow Facility, Was Operating In Compliance With State And Federal Hazardous Waste Regulations.

("Act") Was Inspected By The Florida Department Of Environmental Protection ("Department") On June 22, 2021 To Determine The Facility'S Compliance With State And Federal Hazardous Waste And Used Oil Regulations. Act Is Registered With The Department As A Used Oil, Used Oil Filter And Universal Waste Transporter, Used Oil Transfer Facility And A Hazardous Waste Transporter. Jason Huffman, Emergency Response Project Manager, Accompanied The Department Inspectors Throughout The Inspection. The Facility Operates 8 Am Through 5 Pm, Monday Through Friday, With Emergency Response Operations Occurring 24 Hours Per Day. Approximately 74 Employees Work At Act. The Facility Utilizes City Of Bartow Water And Sewer Services. | Act Is Primarily An Emergency Response Company, But Offers A Variety Of Environmental Services Such As Site Assessment, Sampling, Waste Brokering As Well As Transportation. This Facility Is A Headquarters Office, And A Storage Yard For Their Response Equipment And Vehicles. Most Work Is Done At The Customer’S Site, Not At This Facility. Act Transports Hazardous Waste, Universal Waste, Used Oil, And Routine Waste For Customers As Well As Petroleum-Contact Water/Solids That Is Generated During Spill Cleanups. Hazardous Wastes Are Transported Directly To Another Registered Transporter Or A Permitted Treatment, Storage And Disposal Facility ("Tsdf"), And Not Stored More Than 24 Hours At The Bartow Facility. The Facility Consists Of Offices, As Well As Two Warehouse Buildings (#1 And #2). Warehouse #2 Serves As Their Permitted Solid Waste Processing Building Along With The Inactive Wastewater Pre-Treatment System. At The Time Of The Inspection, The Inspectors Observed Several Properly Closed And Labeled Universal Waste Containers, As Well As Closed And Labeled Containers Of Petroleum Contact Solids Within Warehouse #2. Warehouse #1 Serves As A Maintenance Shop Where They Conduct Routine Maintenance On Their Own Vehicles. Used Oil Registration And Financial Assurance Records Are Up To Date. The Department Selected And Reviewed Hazardous Waste Manifests From The Last Three Years And The Records Appeared To Be Complete. | At The Time Of The Inspection, Act Environmental & Infrastructure, Inc.
