11/18/2008 Site Inspection Routine; Used Oil Transfer Facility Aqua Clean Environmental Company, Inc. Was Inspected November 18, 2008 To Determine The Facility'S Compliance With State And Federal Used Oil And Petroleum Contact Water Managment Regulations. Mr. W.D. Miller Represented The Facility Throughout The Inspection. The Facility Continues To Manage Various Oily Waste Waters In Its Permitted Centralized Waste Water Treatment Unit (Cwt). Waste Water Is Discharged To The City Of Lakeland Sewer System. Petroleum Recovered In The Unit'S Oil/Water Separator Is Transferred To A Used Oil Processor For Further Water Removal And Fuel Blending. Sludges Are Solidified With Sawdust And Disposed Of As Non-Regulated Solid Waste. | Sludges Continue To Be Analyzed By The Tclp Method For Metals And Volatile Organic Compounds Once Per Month By An Off Site Certified Laboratory. All Results Since The Previous Inspection Show The Material To Be Non-Regulated, Although A Couple Of Analyses Show Detections For Metals, Benzene And Solvent Constituents. The Chain Of Custody And Sample Check In Sheets Are Retained And Attached To The Analytical Results And Indicate That The Samples Were Collected In Compliance With Fac Rule 62-160. Since The Previous Inspection, Aqua Clean Has Added The Ability To Screen Samples For Glycols In Addition To Ph And Percent Solids. A Hach Spectrophotometer And Test Kits Are Used And No Analytical Records Are Kept. As The Test Is Used For Internal Screening, Department Qa Program Sops Are Not Applicable. Aqua Clean Is No Longer Allowing Wastes With High Ethylene Glycol To Discharge Directly To The Collection Sump. Instead, These Wastes Are Treated By Discharging Them Onto The Solidification Pad. Liquids That Drain Through The Wood Chips On The Solidification Pad Collect In The Sump At The Headworks Of The Treatment Unit. The Secondary Containment Around The Waste Water Treatment Unit Held Some Oily Water And It Was Recommended That This Material Be Drained To The Headworks As Soon As Possilble. The Source Of The Contamination Was Not Clear. No Leaks Were Observed And The Release May Have Been From A Disconnected Or Leaking Transfer Hose. The Containment System Capacity Met Used Oil Program Requirements Even With The Standing Water. Tanks #8 And #9 Were Labeled "Used Oil." The Recovered Oil Still Has A Relatively High Water Content And Is Sent To Off Site Used Oil Processors For Further Water Removal. Aqua Clean Does Not Intend To Engage In Fuel Processsing Or Marketing At Any Forseeable Time In The Future. Recovered Oil Is Reported On The Facility'S Annual Used Oil And Petroleum Contact Water Reports. Aqua Clean Continues To Rely Upon Certifications Provided By The Generator That The Wastes They Accept Are Not Regulated Hazardous Waste. The Waste Profiles Are Often Incomplete And Do Not Include Analytical Information Or Information On The Process Generating The Waste. The Department Recommends That Analytical Information Be Obtained And Reviewed Prior To Acceptance, As There Have Been Several Incidents Recently Where Regulated Hazardous Wastes Were Shipped To The Facility And Accepted For Treatment Based On Inaccurate Profiles. In February 2008 Aqua Clean Accepted A Load Of Glycerin Bottoms And Storm Water From Agri Source Fuels Without A Flash Point Analysis. Pure Glycerin Is Not Ignitable, However Glycerin Bottoms From Biodiesel Production Contain Enough Methanol To Be Ignitable Hazardous Wastes When Shipped For Disposal. As Aqua Clean Did Not Require A Flash Point Analysis, Agri Source Shipped The Material As Non-Regulated. Better Waste Screening Will Help Prevent Pass Through Interference And Ensure Compliance With The Facility'S Pretreatment Permit. Aqua Clean'S Pretreatment Permit Would Allow Acceptance Of Hazadous Waste For Pretreatment, However The Facility Would Have To Notify As A "Designated Facility" And Comply With The Manifest System For Any Hazardous Waste That Is Knowingly Received. | Aqua Clean Is Currently In Compliance Wi
08/31/2011 Site Inspection Routine; Used Oil Processor A Routine Inspection Was Conducted At Aqua Clean Environmental Company (Aqua Clean) And Florida Recycling Solutions, A Permitted Used Oil Processing Facility. Aqua Clean Is Currently Registered As A Used Oil Transporter And Transfer Facility. Florida Recycling Solutions And Aqua Clean Have The Same Facility Identification Number. Florida Recycling Solutions Was Not Registered As A Used Oil Processor In The Most Recent Registration For The Facility, Dated March 2011. Aqua Clean Processes Industrial Waste Water As An Npdes Permitted Centralized Waste Water Processing Facility. Florida Recycling Does Not Transport Any Material, And Mainly Receives Oil Through Aqua Clean. Aqua Clean Is Currently Still Operating At Partial Capacity Due To Fire Earlier This Year, On July 7, 2011. Mechanical Reconstruction Is Complete, And Staff Anticipate That Full Operation Will Resume Soon. At The Time Of The Inspection, Electrical Work Was 95% Complete, With Some Building Department Inspections Pending. Mike Zellars, The Plant Manager And Audrey Scruggs, The Office Manager Provided Assistance During The Inspection. | The Fire At The Facility Was Caused By A Contractor Conducting Welding During Vehicle Unloading Operations. A Load Of Material Shipped To Aqua Clean As "Non Hazardous Non Dot Regulated (Water With Trace Petroleum Product)" From The Marathon Petroleum Ft. Lauderdale Bulk Terminal Was Unloaded Into The Facility'S Open Collection Sump. Dense Vapors From Unloading Traveled Along The Ground Surface To The Welding Operations, Ignited And Flashed Back To The Truck. As A Result Of The Fire, A Control Panel And Several Tanks Were Damaged. The Facility Has Continued To Accept Waste Water During Repair Operations. Other Changes Since The Previous Inspection Included Installing Insulation On Florida Recycling'S Used Oil Processing Tanks. The Insulation Covered The Old Labels On Tanks 6 And 7. New Labels Had Been Received, But Not Yet Applied To The Tanks. The Facility Is Currently Having Problems With Excess Storm Water From The Summer Rainy Season. Storm Water Collects From Traffic Areas Into The The Open Pit Used To Unload Vacuum Trucks. The Pit Was Full At The Time Of The Inspection, And The Sump Previously Used To Transfer Waste Water To The Water Treatment Tanks Was Also Full. A Trench Had Been Opened In The Pavement Nearby To Place New Electrical Lines To The New Control Panel. The Solidification Pad Was Full Of Wood Chips Soaking Up Excess Liquid. The Facility Disposed Of 37 - 26 Cubic Yard Loads Of This Material Between August 24 An August 31 To The Cedar Trails Landfill In Polk County. The Sludge Is Analyzed Once A Calendar Month, And Has Not Been Found To Be Characteristically Hazardous. Ms. Scruggs Indicated That This Is Typical Of The Current Rate Of Generation. Neither Florida Recycling Solutions Nor Aqua Clean Had Shipped Any Recovered Oil Off Site As Of The Initial Date Of The Inspection. The Facility Intends To Burn Its On-Specification Processed Oil In An On Site Process Heater To Assist In Treatment. In A Telephone Conversation After The Inspection, Mike Zellars Stated That Florida Recycling Had Recently Shipped 6,000 Gallons Of Oil To Synergy. The Containment Area Around The Pumps Of The Unloading Area On The East Side Of The Solidification Pad Had Standing Discolored Water That Could Not Fully Drain Back To The Plant Headworks. The Storm Water Containment And Aeration Tank North Of The Large Tank Farm And South Of The Traffic Area Contained Contaminated Water, Dark In Color, And With A Sheen That Appeared To Be Biological In Origin Rather Than Petroleum. The Biofilm Was Also Noted In The Lined Ditch Leading From The Aeration Tank To The Storm Water Pond. No Sheen Was Observed On The Pond. The Facility'S Permit Requires Removal Of Collected Storm Water Within 24 Hours From Secondary Containment Areas Around Units Containing Used Oil. Records Were Reviewed, Including All Incoming Manife

Aqua Clean Is A Registered Transporter Of Used Oil, Petroleum Contact Water And Used Oil Filters. Aqua Clean Also Operates A Centralized Waste Pretreatment Facility At This Location That Discharges To The City Of Lakeland Sewer System And A Second Plant That Discharges To The City Of Tampa. Florida Recycling Solutions Is A Permitted Used Oil Processor, And Receives Oil Transported By Aqua Clean Environmental Company And Also Oil That Aqua Clean Recovers From Oily Waste Water And Petroleum Contact Water. Records For Both Companies And Both Locations Are Maintained At This Office. Mike Zellars, The General Manager And Audrey Scruggs Provided Information During The Inspection. | Aqua Clean/Frs Operations Are Discussed In Previous Inspection Reports. At The Time Of This Inspection, Aqua Clean Had Almost Completely Rebuilt Its Operations After A Fire That Occurred At The Facility On April 3, 2012. Mr. Zellars Reported That Verbal Approval To Resume Full Operation Of The New Electrical Panel Had Been Granted As Of August 10, 2012. The Fire Occurred During The Unloading Of Petroleum Contact Water And Fuel Into An Open Sump. The Material Was Generated By Petroleum Aids In Gainesville, Florida And Transported By Aqua Clean. It Was Not Described As A Usdot Flammable Or Combustible Liquid On The Waste Profile Or Shipping Papers. The Department'S Northeast District Office Inspected Petroleum Aids As A Result Of This Incident, And Further Action Is Pending. Southwest District Staff Met With Aqua Clean Representatives On April 17, 2012 To Discuss The Incident As Well As The Pending Issue Regarding Waste Profiles Noted During The August 31, 2011 Inspection. Aqua Clean Is Now Unloading All Petroleum Contact Water Via Hose Connection. On May 29, 2012, Department Staff Provided Aqua Clean With Written Comments On Perceived Problems With Aqua Clean'S Current Waste Profiling Practices. In The Past, These Have Resulted In Aqua Clean Receiving Shipments Of Undeclared Hazardous Waste. Although Off-Specification Fuel And Petroleum Contact Water Are Not Hazardous Waste When Recycled For Energy Recovery, They Are Not Exempt From Usdot Regulations As Hazardous Materials When They Are Also Flammable Liquids. Aqua Clean Was Previously Registered With Usdot To Carry Hazardous Materials, But Let That Registration Lapse. This Was Discussed With Mr. Zellars Previously, And Also During This Inspection. The Company'S Registration Was Renewed August 29, 2012. Additional Usdot Hazmat Training Was Also Recommended, As Aqua Clean Drivers Often Bulk Containerized Materials For Transport And Therefore Are Performing Hazmat Functions On Behalf Of Their Customers. Another Usdot Compliance Issue Was Noted With Regard To Batches Of On-Specification Recovered Oil Marketed By Florida Recycling Solutions. Batches Have Been Tested And Have Exhibited Flash Points Ranging From 118 Degress F To 170 Degrees F. The Oil Met The 40 Cfr 279.11 Specifications For Used Oil Fuel, However The Shipping Papers For The Materials Included Improper Usdot Shipping Descriptions. In Each Case, The Oil Was Described As "Used Oil - Flash Greater Than 200 Degrees F." The Oil Was Accepted And Transported By Synergy Recycling Of Central Florida, Which Was Also Not Registered With Usdot To Transport Hazardous Materials. One Load Was Also Provided To January Environmental Services, For Sale As Burner Fuel To Peace River Citrus. January Is Registered To Transport Hazmat With Usdot. Failure For A Used Oil Transporter To Comply With Usdot Regulations Is A Violation Of 40 Cfr 279.43(B) In Addition To Violating Applicable 49 Cfr 171-173 Standards. Synergy Has Registered With Usdot Effective September 5, 2012. Mr. Zellars Had Recently Met With City Of Lakeland Representatives Regarding A Parallel Case Regarding Waste Profiles. Aqua Clean Is

04/15/2013 Site Inspection Routine; Used Oil Processor Aqua Clean Environmental (Ace)/Florida Recycling Solutions (Frs) Was Inspected On April 12, 2013, To Determine The Facility'S Compliance With State And Federal Hazardous Waste And Used Oil Regulations. Ace And Frs Are Sister Corporations That Share This Facility And This Epa Identification Number. Ace Is A Registered Transporter Of Used Oil, Used Oil Filters, And Petroleum Contact Water (Pcw). Ace Also Operates A Centralized Waste Pretreatment Facility At This Location That Discharges To The City Of Lakeland Sewer System. Frs Is A Permitted Used Oil Processor And Receives Used Oil Transported By Ace. Frs Is Also Permitted To Process Oil Contaminated Debris. | Ace/Frs Operations Are Discussed In Detail In The Facility'S Used Oil And Material Processing Permit. Minor Descrepancies In The Permit And Operations Include: Frs Currently Only Has And Uses One Boiler To Burn On Specification Used Oil Incidently To Processing Used Oil. The Annual Report By Used Oil And Used Oil Filter Handlers Submitted To The Department By Frs For 2012 Indicates That The Facility Only Burned 321 Gallons Of On Specification Used Oil In 2013. The Department Has Received Several Complaints About Off-Site Odors At The Ace/Frs Facility. Department Staff Detected Odors On-Site During The Inspection And Discussed Possible Odor Sources And Current Odor Control Measures Taken Onsite With Facility Staff. The Department Requests That Ace/Frs Provide Information Regarding On-Going Odor Investigation And Remediation Efforts At The Facility. Excessive Dust Was Also Observed On Site During This Inspection. The Department Requests That Ace/Frs Employ A Method Of Dust Control, Such As A Screened Cover, For The Piles Of Sawdust Stored On Site To Prevent Off-Site Dust Migration. | At The Time Of The Inspection, Aqua Clean Environmental/Florida Recycling Solutions Was Not Operating In Compliance With State And Federal Used Oil Regulations And With Their Used Oil Processor Permit. Waste Liquid From The Spray Chamber Is Caught In A Container Below The Spectrometer. The Container Was Closed But Unlabeled. The Waste Liquid Has A Ph Of 6.5 To 7.5 And Is Emptied Every 4-5 Months. While This Material Is Not Corrosively Hazardous Waste, Dep Recommends Labeling The Satellite Accumulation Point. Lab Staff Are Using The Hach Company’S Ez-Cod Recycling Program For Their Used Sample Vials With Disposal By Heritage Environmental Services. As Of The Inspection Date No Shipment Has Been Sent Off. Unused Sample Material Is Returned To The Sump Area Where Unloading Occurs. Ace And Frs Are Sister Corporations That Share This Facility And This Epa Identification Number. | The Facility Is A Transporter And Processor For Used Oils/Filters And Petroleum-Contact Water (Pcw), And Oil-Contaminated Debris. The Facility Has Storage Tanks, And Also A Pcw Pretreatment System That Discharges To The Municipal Sewer System Under Permit. Operations Remain Essentially The Same, And Are Discussed In More Detail In The Facility'S Used Oil And Material Processing Permit, And In Previous Inspection Reports. • All Records Appeared To Be In Order, And Updated, Including Weekly Inspection Logs, Lab Reports, Profiles, And Shipping Papers. Every Shipment, Incoming And Outgoing, Has Shipping Papers (E.G., Receipts Or Manifests), Describing The Materials And Amounts, As Well As Shipper And Receiver. • The Facility Has An Spcc/Contingency Plan.
