Cbi Provides Emergency Response Cleanup For Transportation Accidents And The Clean Up And Removal Of Hazardous And Non-Hazardous Waste From Industrial Spills. Cbi Is Also A Registered Used Oil And Used Oil Filter Transporter. All Sections Of 40 Cfr Cited In This Report Have Been Adopted By Reference In Chapter 62-730, Florida Administrative Code (Fac).
On May 11, 2005, Cbi, Jacksonville Branch, Notified The Department That It Was A Hazardous Waste And Used Oil Transporter, A Used Oil Transfer Facility, A Used Oil Processor, And A Used Oil Marketer. A Subsequent Notification On June 17, 2008, Showed The Facility To Be A Hazardous Waste And Used Oil Transporter, Used Oil Processor, And Used Oil Filter Transporter. On February 12, 2007, Cbi Applied For A Permit To Become A Used Oil Processor. The Department Issued An Intent To Issue Permit Letter To Cbi On March 13, 2008. According To Ms. Ileana Smothers, Cbi Has Placed Its Used Oil Processing Intentions On Hold For The Foreseeable Future. The Facility Re-Notified On September 02, 2008, As A Hazardous Waste And Used Oil Transporter, A Used Oil Filter Transporter, And A Used Oil Processor.
Inspection:
Cbi Accepts And Transports Hazardous Waste, Used Oil And Used Oil Filters. Cbi Has Fulfilled The Requirements Of Rule 62-730, Fac, To Transport Hazardous Waste And Rule 62-710, Fac, To Transport Used Oil.
According To The Hazardous Waste Manifests Supplied By The Facility, Cbi Is Accepting And Transporting Small Quantity Generator (Sqg) And Large Quantity Generator (Lqg) Amounts Of Hazardous Waste. A Hazardous Waste Manifest Is Required To Accompany Shipments Of Sqg And Lqg Hazardous Waste.
A Review Of The Facility'S Hazardous Waste Manifests During Both Inspections Showed That The Facility Was Missing The Signature And Date Of Acceptance Of The Treatment, Storage, Or Disposal (Tsd) Facility On Numerous Manifests, Including Two Manifests From The 08/06/07 Inspection (Numbers 000466701 And 000466702) And Nearly All Of The Manifests Examined During The 11/07/08 Inspection. Failure Of A Hazardous Waste Transporter To Obtain The Date Of Delivery And The Handwritten Signature Of The Owner Or Operator Of The Designated Facility On The Manifest Is A Violation Of 40 Cfr 263.20(D).
The Hazardous Waste Manifests Supplied By The Facility During Both Inspections (See Tables 1 And 2) Indicate That Cbi Stored Hazardous Waste That Requires A Manifest Longer Than 24 Hours At Its Facility Prior To Delivery To The Designated Disposal Facility. During The 11/07/08 Inspection, Ms. Smothers Stated That Hazardous Waste Is Not Kept On Site For More Than 24 Hours, But That It Is Often Delivered To Cbi'S Transfer Facility In Miami Where It Is Held For Several Days Before Final Delivery To The Disposal Facility. Ms. Smothers Also Stated That This Delivery To The Transfer Facility Is Not Marked On The Manifests. This Is An Area Of Concern. The Facility Should Acquire The Waste Tracking Records From The Transfer Facility For The Shipments Listed In Tables 1 And 2. These Records Should Be Submitted To The Department For Review.
A Review Of The Facility'S Used Oil Acceptance Records During The 11/07/08 Inspection Showed That The Facility Was Missing Documentation Of Halogen Screening On Two Separate Manifests. Failure Of A Used Oil Transporter To Document The Halogen Screening Of Used Oil Shipments Is A Violation Of 40 Cfr 279.44(D).
According To Ms. Smothers, Cbi Routinely Performs Training For Its Used Oil Transporting Activities; However, The Facility Was Unable To Provide Documentation Of This Training During The 11/07/08 Inspection. Nine Would Be For Oily Wastewater, And One Would Be For Petroleum Contact Water (Pcw). The Facility Intends To Bring Oily Wastewater Back To Its Facility For Processing Instead Of Taking It To A Third Party For Processing.
The Facility Is Currently Operating As A Registered Used Oil Transporter And Transfer Facility. The Facility Is Also A Hazardous Waste Transporter And Used Oil Filter Transporter And Transfer Facility. | Cbi'S Current Operation Consists Of An Office Building, A Large Storage Warehouse, And A Used Oil Storage Area. The Office Building And The Storage Warehouse Do Not Generate Any Waste. These Two Areas Are Used To Store Boats, Pumps, Hoses, Boom, And Other Spill Cleanup Inventory.
Used Oil Storage:
The Facility Has Three Double-Walled Tanks Including One 15,000-Gallon Tank With Two Compartments Of 10,000 And 5,000-Gallon Capacities, One 2,000-Gallon Tank, And One 4,000-Gallon Tank. The Tanks Were Properly Labeled And Appeared To Be In Good Condition. Next To The Tanks Is An Area For Storing Used Oil Generated From The Loading And Off-Loading Of Used Oil Into The Tanks (Photo 2). The Facility Places Buckets Underneath The Hose Fittings During Off-Loading, And Any Used Oil That Drips Into These Buckets Is Captured And Added To The Used Oil Drum. This Drum Was Properly Labeled And In Secondary Containment. There Was Also One Drum Of Oily Rags From The Off-Loading Operations And One Drum Of Petroleum Contact Water (Pcw) From A Customer. These Drums Were Properly Labeled.
The Facility Ships Used Oil To Its Miami Facility To Be Processed And Sold As A Fuel. According To Facility Records, The Last Shipment Of Used Oil From This Location To Miami Was On March 8, 2012.
Non Hazardous Waste And Used Oil Filter Storage:
The Facility Has A Semi Trailer On-Site To Store Non-Hazardous Waste, Universal Waste, And Used Oil Filters It Receives From Its Customers. The Facility Keeps A Log Of What Drums Are In The Trailer And When They Were Delivered. At The Time Of The Inspection, There Were 12 Drums In The Trailer. These Drums Were Properly Labeled, Closed, And In Good Condition.

The Waste Storage Area Consists Of A Sealed, Secondary Containment Pad Where One Semitrailer Containing Non-Hazardous Waste, Universal Waste, Used Oil And Used Oil Filters Is Parked (Photo 1). The Secondary Containment Area Is 111' Long By 25' Wide By 4" Deep And Is Calculated To Hold 6,850 Gallons. The Facility Maintains A Log Of The Date, Manifest Number, Customer, Quantity Of Drums And Content Of The Drums That Are Loaded Into The Trailer. At The Time Of Inspection, There Were Three Boxes Of Universal Waste Lamps And One 5-Gallon Container Of Universal Waste Batteries, In Addition To The Non-Hazardous And Empty Drums Accumulating In The Trailer. All Inspected Containers Were Closed, In Good Condition And Properly Labeled.
The Facility Is Reminded That The Secondary Containment Coating Should Be Oil-Impermeable When Used Oil Or Used Oil Filters Are Stored In This Area. There Was Some Peeling Of The Coating Surface In The Vicinity Of The Loading Rack (Photo 2).

The Ast Area Is Located Northwest Of The Storage Warehouse (Photos 3 And 4). There Is One Double-Walled Tank And Six Single-Walled Tanks Installed And Operating Within A Walled Secondary Containment Area. There Is A Curbed, Secondary Containment Pad For Use During Truck Loading And Unloading.
The First Tank Has A 15,000-Gallon Total Capacity But Is Divided Into Two Compartments (Compartments Labeled 1 And 2). Compartment 1 Has A 5,000-Gallon Capacity And Compartment 2 Has A 10,000-Gallon Capacity. Both Compartments Are Currently Being Used To Store Used Oil. The Second Tank (Compartments Labeled 3, 4 And 5) Is A 30,000-Gallon, Three Compartment Tank. All Three Compartments Have A 10,000-Gallon Capacity And Are Used To Store Used Oil. Tank 6 Is A 12,000-Gallon Vertical Tank That Is Used To Store Oily Water. Tank 7 Is A 25,000-Gallon Vertical Tank That Is Used To Store Oily Water. Tank 8 Is An 8,000-Gallon Vertical Tank That Is Used To Store Pcw. Tank 9 Is A 12,000-Gallon Vertical Tank That Is Used To Store Oily Water. Tank 10 Is A 25,000-Gallon Vertical Tank That Is Used To Store Oily Water.
