02/13/2018 Site Inspection Routine; Used Oil Transporter - Routine; Used Oil Transfer Facility A Compliance Evaluation Inspection Was Conducted At Universal Environmental Services Llc [Ues/Facility] On February 13, 2018 To Verify The Facility'S Compliance Status With State And Federal Used Oil Rules And Regulations. This Is The First Fdep Hazardous Waste/Used Oil Inspection Conducted At Ues. The Following Is A Summary Of My Observations. Ues Submitted An Initial 8700-12fl Notification On 11-17-17 As A Used Oil Transporter (Uot) And Used Oil Transfer Facility (Uotf) And Was Issued A Registration Certificate And Associated Epa Id# On 1-23-18. According To The Notification, Ues Began Operating At This Location On 10-1-17. As Part Of Their Registration, Ues Submitted An Annual Report For 2017 Which Reflects 117,097 Gallons Of Used Oil Was Transported To/From The Facility October - December 2017. The Current Registration Expires 6-30-19. The Property Is Owned By Edison Oil Company (Eoc). Eoc Is A Bulk Oil Storage Facility. Ues Leases Three 15,000 Gallon Aboveground Storage Tanks From Eoc To Operate A Uotf. The Storage Tank System (Facility Id 8519437) Is Registered To Eoc. The Tank Registration Reflects The Three Leased Tanks (#'S1,2 And 4) Contain 'New/Lube Oil' And Should Be Revised To 'Used Oil'. The Tank System Was Last Inspected By Lee County Division Of Natural Resources On 5-7-15 And Determined To Be In Compliance. Eoc Maintains Financial Assurance For The Tank System And Was Verified To Be Current [3-21-17 To 3-21-18] At The Time Of The Inspection. Ues Also Maintains Financial Assurance And Verified To Be Current [1-1-18 To 1-1-19]. All Records Associated With Ues Are Maintained By Michael Schorr, Avista Oil Group Environmental Safety & Health Manager, In Peachtree City, Georgia. Prior To The Inspection, Mr. Schorr Was Contacted Regarding This Inspection. Upon Arriving At The Facility, I Reviewed The Purpose Of The Inspection With Mr. Schorr And Ken Rittscher, Ues Florida Area Manager. Mr. Schorr And Mr. Rittscher Provided Us Access To Conduct The Inspection And Were Present Throughout The Inspection. Mr. Pat Mccaig Of Eoc Was Also Present And Participated In The Inspection. | The Current Tank Registration Reflects The Three Leased Tanks #1,2 And 4 Contain 'New/Lube Oil'. Eoc Should Revise Their Tank Registration To Accurately Reflect The Contents Of The Storage Tanks [Including Tank #3]. It Is Recommended To Routinely Inspect/Ensure The Drain Valve Is In The Closed Position When Not Discharging Rainwater And To Maintain A Lock On The Drain Valve To Ensure It Remains Closed. The Container Storing Oily Absorbent Pads Should Be Labeled According To Its Contents. | Ues Operates As A Used Oil Transporter And Transfer Facility. Used Oil Is Picked Up From Generators, Monday - Friday, And Transported To This Facility For Consolidation And Eventual Transport To The Ues Re-Refinery Facility In Peachtree City, Georgia [Epa Id# Gar000020131]. According To The Ues Representatives, This Facility Maintains One Truck And One Driver For Pick-Ups From Generators. The Truck Has Two Compartments: 3,900-Gallons And 500-Gallons For A Total Capacity Of 4,400-Gallons. Mr. Schorr Indicated That They Primarily Pick Up Used Oil But May Occasionally Pick Up Used Antifreeze And Oily Water. No Used Oil Filters Are Transported Or Stored At This Facility. At The Time Of The Inspection, The Truck And Driver Were Not At The Facility. According To Ues Representatives, The Transporter Registration Form And Epa Identification Number Are Maintained In The Truck, As Well As Proper Emergency Response And Spill Equipment. Halogen Leak Detectors (Sniffers) Are Used At Every Generator Location. If The Sniffer Detects The Presence Of Halogenated Compounds, A Chlor-D-Tect Test Is Conducted. Ues Representatives Indicated They Have Not Detected Any Exceedances Greater Than 1000 Ppm At Any Generators. 10/14/2021 Site Inspection Routine; Used Oil Transporter - Routine; Used Oil Transfer Facility A Compliance Evaluation Inspection Was Conducted By Florida Department Of Environmental Protection (Fdep) Hazardous Waste Staff At Universal Environmental Services (Ues/Facility) On October 14, 2021 To Verify The Facility'S Compliance Status With State And Federal Used Oil Rules And Regulations. The Following Is A Summary Of My Observations. This Facility Was Previously Inspected By Fdep Hazardous Waste Staff On 02-13-2018 And Was Not In Compliance At That Time. Violations Cited Included Failure To Register Used Oil Handling Activities With Fdep And Failure To Maintain Entire Containment System Sufficiently Impervious To Used Oil. The Violations Were Corrected And The Case Was Closed With Formal Enforcement. Ues Is Currently Registered With Fdep As A Used Oil Transporter For Hire, Used Oil Transfer Facility, Used Oil Filter Transporter And Used Oil Filter Transfer Facility. The Registration Expires 06-20-2022. According To The Previous Inspection Report, Ues Has Been Operating At This Location Since 10-01-2017. The Ues Corporate Office Is Located At 411 Dividend Drive, Peachtree City, Georgia. Lee County Property Appraiser Records Identify Edison Oil Company (Eoc) As The Property Owner Of 6940 Mission Lane, Fort Myers, Fl. Eoc Is A Bulk Oil Storage Facility. Ues Leases Three 15,000-Gallon Aboveground Storage Tanks (Asts) From Eoc. The Storage Tank System (Facility Id 8519437), Consisting Of 14 Asts, Is Registered To Eoc. It Was Noted That The Tank Registration Reflects The Three Leased Tanks (#'S 1,2 And 4) Contain 'New/Lube' Oil And Should Be Revised To 'Used Oil' Or 'Waste Oil'. The Tank System Was Last Inspected By Lee County Division Of Natural Resources On 04-21-2021 And Determined To Be In Compliance. Eoc Maintains Financial Assurance For The Tank System And Was Verified To Be Current Prior To The Inspection [03-21-2021 To 03-21-2022]. This Facility Is Unmanned By Ues Personnel. Prior To The Inspection, Michael Schorr, Ues Director, Governmental And Regulatory Affairs, Was Contacted Regarding The Inspection. Mr. Schorr Granted Permission To Conduct The Inspection And Agreed To Provide All Requested Documentation Electronically. Upon Arriving At The Facility, The Purpose Of The Inspection Was Reviewed With Lane Bryant, Ues Florida Operations Manager. Mr. Bryant Provided Access And Was Present Throughout The Inspection. Walter (Gene) Eakins Jr., President Of Eoc And Don Hendshaw, Lubricant Sales Of Eoc, Were Also Present At The Conclusion Of The Inspection. | Ues Transports Used Oil From Generator Sites, Monday - Friday, To This Location Where It Is Stored In Storage Tanks Until Transported To The Ues Re-Refinery Facility In Peachtree City, Georgia [Epa Id# Gar000020131] For Processing. The Facility Is Surrounded By A Chain-Link Fence Secured With An Access Gate. The Gate And Fence Appeared To Be In Good Condition. Mr. Eakins Indicated That The Gate Is Locked At Night. According To Ues Representatives, This Facility Utilizes One Truck And One Driver For Transporting Used Oil. Ues Representatives Indicated They May Also Occasionally Pick Up Used Antifreeze And Oily Water. No Used Oil Filters Are Transported Or Stored At This Facility. At The Time Of The Inspection, The Truck And Driver Were Not At The Facility. According To Ues Representatives, The Transporter Registration Form And Epa Identification Number Are Maintained In The Truck, As Well As A Contingency Plan And Emergency Response And Spill Equipment. Drivers Complete An Equipment Checklist On Their Phones Every Morning Ensuring The Truck Is Equipped With Proper Equipment. Halogen Leak Detectors (Sniffers) Are Used At Every Generator Location To Test The Halogen Content In Used Oil And Oily Water Prior To Collection. If The Sniffer Detects The Presence Of Halogenated Compounds, A Chlor-D-Tect Test Is Conducted. Ues Representatives Indicated They Have Not Detected Any Exceedances Greater Than 1000 Ppm At Any Generators. According

09/07/2023 Site Inspection Routine; Used Oil Transporter - Routine; Used Oil Transfer Facility Universal Environmental Services Llc (Hereinafter, “Ues” Or “Facility”), Located At 6940b Mission Lane, Fort Myers, Lee County, Florida Was Inspected By The Florida Department Of Environmental Protection (Dep Or Department) On September 7, 2023 (09/07/2023), To Determine The Facility’S Compliance With The State And Federal Hazardous Waste Regulations Described In Title 40, Code Of Federal Regulations (Cfr) Parts 260-268, 40 Cfr Part 273, And 40 Cfr 279, Adopted And Incorporated By Reference In Chapters 62-710 And 62-730, Florida Administrative Code (F.A.C.). All Records Associated With Ues Are Maintained By Michael Schorr, Ues Director Of Governmental And Regulatory Affairs, In Peachtree City, Georgia. Prior To The Inspection, Mr. Schorr And Alex Castaneda, Ues Operations Manager, Were Contacted Regarding This Inspection. Upon Arrival At The Facility The Inspectors Were Met And Escorted Around The Facility By Mr. Castaneda. Walter (Gene) Eakins Jr., Vice President Of Eoc And Don Hendshaw, Lubricant Sales Of Eoc, Were Also Present At The Conclusion Of The Inspection. Notification History: The Facility Initially Notified And Registered With The Department As A Used Oil And Used Oil Filter Transporter And Transfer Facility In November 2017. The Facility Was Assigned The Epa Identification (Epa Id) Number Flr000225029. The Facility’S Most Recent Registration Was Submitted In February 2023. As Part Of Their Registration, Ues Submitted An Annual Report For January – December 2022 Which Reflects 803,794 Gallons Of Used Oil Was Collected At The Facility, Of Which 781,210 Gallons Was Transported From The Facility Out Of State, And 17,373 Gallons Was Treated In-State At A Wastewater Treatment Unit. The Current Registration Expires 06/30/2024. Inspection History: The Facility Was Previously Inspected By The Department On 02/13/2018 And 10/14/2021. The 2018 Inspection Resulted In Enforcement Actions For Failure To Register With The Department As A Used Oil Transporter And Transfer Facility, And For Failure To Provide Adequate Secondary Containment For Used Oil Storage. Personal Protective Equipment (Ppe) Was Required To Enter The Facility. Inspectors Were Equipped With Steel-Toed Boots. | Lee County Property Appraiser Records Reflect Edison Oil Company Inc. (Eoc) Owns The Approximate 85,000 Sf Property. Eoc Operates A Bulk Oil Storage Facility, Which Includes Fourteen (14) Aboveground Storage Tanks (Asts) Registered With The Department (Facility Id: 8519437). The Tank System Was Last Inspected By Lee County Division Of Natural Resources On 04/07/2021 And Determined To Be In Compliance. Eoc Maintains Financial Assurance For The Tank System And Was Verified To Be Current At The Time Of The Inspection. Eoc Maintains A Spill Prevention, Control And Countermeasures (Spcc) Plan For The Site. The Facility Is Surrounded By A Chain-Link Fence Secured With An Access Gate. The Gate And Fence Appeared To Be In Good Condition. Ues Leases Two (2) 15,000-Gallon Horizontal-Mounted, Single-Walled Aboveground Storage Tanks (#1&2) From Eoc And Operates A Used Oil And Used Oil Filter Transfer Facility At This Location (Photo 1). According To Dep'S Database, Universal Environmental Services’ Registration For Used Oil Handler Activities At This Address Was Renewed On 02/28/2023 And Expires On 06/30/2024. The Tank System Is Situated Within A Concrete Block Secondary Containment Structure. Gene Eakins, Vice President Of Edison Oil Company, Confirmed That The Secondary Containment Structure Is Sealed And Painted Every 3-5 Years, And Most Recently Done In June 2022. Rainwater That Collects In The Containment Structure Is Discharged Via A Drain Sump Located In The Southwest Corner Of The Containment Structure. The Drain Port/Valve Was Verified Closed At The Time Of The Inspection. According To Mr. Eakins, The Containment Is Drained Regularly. Any Accumulated Water Is First Visually Inspected For Sheen Or Order And Absorbent Material Used If Necessary To
