The Inspector Was Accompanied By Dep Representatives Jared Heyns; Environmental Specialist Ii, Juliana Reis; Environmental Specialist I, And Ckc Representatives Jason Gross; Environmental Specialist, Nicolas Ramos, General Manager, And Christian Ramos, Vp. The Facility Is Situated On Approximately 106,261 Square Feet Property, Has 7 Employees, And Is On Public Water And Sewer. The Facility Has Been Operating On Site Since May Of This Year. Notification History: 3/25/2019 - Notified As A Hazardous Waste Transporter, Used Oil Transporter, Used Oil Filter Transporter. Inspection History: Never Inspected By The Department At This Location. Ckc Just Moved To This Location From 2356 W 80th St Suite 1, Hialeah, Fl 33016 On May Of 2019. The Previous Location Was Inspected By Dep On 12/4/2018 And No Violations Were Found. | Ckc Is A Transporter For Hazardous Waste And Used Oil. Upon Arriving At The Facility, The Inspectors Showed Ckc Representatives Their State Issued Credentials As Required. The Inspector Toured The Facility With Ckc Representatives And Reviewed Used Oil And Hazardous Waste Transporter Practices. The Inspectors Toured Two Areas Of The Facility. The Offices Where Administrative Work Is Done, And No Hazardous Waste Was Observed, And The Warehouse. Warehouse: Along With Handling And Disposing Of Hazardous Waste, And Used Oil, Ckc Also Transports Products To Generators Like Mineral Spirits. Ckc Is Not A Transfer Facility For Hazardous Waste, Ckc Insteads Transports Hazardous Waste Directly To The Next Transporter Or Designated Facility During The Course Of Transportation (Within 24 Hours). Ckc Transports Hazardous Waste From The Generator Directly To The Transfer Facility Stericycle Specialty Waste Solutions (Epa Id Fl000702985). Ckc Transports Used Oil To Its Own Facility Where It Stores Its Used Oil. During The Inspection The Inspectors Observed: >> Five (5) 55-Gallon Drums For Used Oil, Closed, Property Labeled With The Words "Used Oil", And On Secondary Containment Pallets. Upon Observing These Five (5) 55-Gallon Drums For Used Oil, The Inspectors Asked Ckc To Provide Manifests To Demonstrate The Inbound And Outbound Documentation To Verify How Long The Aforementioned Drums Have Been On-Site For. (The Observations Of The Manifests Will Be Discussed In The Record Review (C)). The Inspectors Also Observed: >> Eight (8) Closed 55-Gallon Drums Which Contained Non-Hazardous Rinse Water. >> Twenty-Two (22) Closed 55-Gallon Drums Which Contained Non-Hazardous Ink. >> Four (4) Closed 55-Gallon Drums Which Contained Non-Hazardous Waste Water. >> One (1) Closed 55-Gallon Drum Which Contained Non-Hazardous Non Destructing Testing (Ndt) Water. >> Twenty-Seven Closed (27) Cubic Yard Cardboard Boxes Which Contained Non-Hazardous Paper Towels Containment With Ink. >> Two (2) Closed 55-Gallon Drums Which Contained Oily Rags. >> Two (2) Closed 55-Gallon Drums Which Contained Used Oil Filters. >> One (1) Closed 55-Gallon Drum Which Contained Oily Wastes. During The Time Of Inspection, No Hazardous Waste Was Observed On-Site. The Facility Has Two (2) Box Trucks That Are Used To Transport Used Oil And Hazardous Waste. Both Trucks Have Dot Placards Displayed On The Sides Of The Trucks, The Transporters Keep Copies Of The Permits, Notifications, Contingency Plan (In Case Of Emergency) And Manifests On The Truck. Also, The Trucks Are Properly Identified For Their Corresponding Wastes And Have Fire Extinguishers And Spill Kits Available On Site. Record Review: A) Transport, Receiving And Shipping Records Were Available For Review At The Time Of Inspection. The Facility Has Maintained Records Since The Start Of Operation And Was Advised To Retain All Records Of Transportation And Trai

11/12/2019 Enforcement Tracking Finished-11/12/2019 The Facility Was Categorized As A Snc On August 16, 2019. The Facility Returned To Compliance On August 13, 2019 By Providing Documentation Of The Corrective Actions. After Further Review Of The Ogc Guidelines For Characterization Of Used Oil Violations, The District Recommends Closure Without Formal Enforcement In Accordance With The Specific Assistance Guidance For Rcra Hazardous Waste Program Dated 8/2/14. The Case Was Closed Without Enforcement After The Department Has Determined That Pursuing Formal Enforcement Against Chem Klean Corp Would Not Be Appropriate Based On The Ogc Guidelines Recommendations. However, The Department Will Closely Monitor The Activities Of The Facility To Confirm That Complies With All Rcra Regulations. The Ogc No.19-1600 Was Assigned To This Case, But The Department Did Not Issue Any Consent Order Against Chem Klean Corp And No Penalties Were Pursued At This Time.

Ck Was Inspected To Determine The Facility’S Compliance With The State And Federal Hazardous Waste Regulations Described In Title 40, Code Of Federal Regulations (Cfr) Parts 260-268, Adopted And Incorporated By Reference In Rule 62-730, Florida Administrative Code (F.A.C.)., As Well As The State Used Oil Rule 62-710 F.A.C. The Inspector Was Escorted Around The Facility By Nicolas Ramos, General Manager. Upon Arrival At The Facility The Inspector Presented Their Credentials And Explained The Purpose Of The Inspection. Ck Occupies Approximately 106,000 Square Feet And Is Connected To Public Water And Sewer. Ck Has Been Operating At Its Current Location Since May 2019 And Employs 7 Staff. The Facility Office Operates Normal Daytime Hours. Notification History: Ck Initially Notified With The Department As A Hazardous Waste Transporter, Used Oil Transporter, And Used Oil Filter Transporter On 03/25/2019. The Facility Was Assigned The Epa Identification (Epaid) Number Flr000231258. Ck Most Recently Notified As A Hazardous Waste Transporter, Used Oil Transporter, Used Oil Filter Transporter, And Used Oil Transfer Facility On 05/03/2021. Inspection History: The Facility Was Previously Inspected By The Department On 05/29/2019 As A Hazardous Waste And Used Oil Transporter And Was Found To Be Out Of Compliance At The Time Of Inspection. The Violations Were Pertaining To Acting As An Un-Registered Used Oil Transfer Facility And Manifest Issues. The Facility Corrected The Violations And The Case Closure Letter Was Issued On November 12, 2019 (11/12/2019). Safety Boots And Safety Glasses Were The Only Personal Protective Equipment (Ppe) Required To Enter The Facility. The Department Inspector Was Also Equipped With A Face Mask. | Ck Is A Transporter For Hazardous Waste (Hw) And Used Oil And A Transfer Facility For Used Oil. The Facility Consists Of Two Areas: The Office Where Administrative Work Is Done, And The Warehouse Where All Transport/Transfer Operations Occur. The Department Inspector Toured The Warehouse Before Conducting A Record Review. The Department Inspector Verified That Ck Is Not A Transfer Facility For Hw; Instead, Ck Transports Hw Directly To The Next Transporter Or Designated Facility (Stericycle Specialty Waste Solutions, Epaid Fl000702985) Within 24 Hours. The Facility Asked About The Requirements For Hw Transfer Facilities And On-Site Compliance Assistance Was Offered Pertaining To The Facility Potentially Re-Notifying As A Hw Transfer Facility. Ckc Transports Used Oil To Its Own Facility Where It Stores Its Used Oil. During The Inspection The Inspector Observed: • Thirteen 55-Gallon Steel Drums Containing Used Oil. • Two 5-Gallon Poly Buckets Containing Used Oil. All Containers Were Observed To Be Closed, Properly Labeled With The Words "Used Oil", And On Secondary Containment Pallets. During The Time Of Inspection, No Hw Was Observed On-Site. The Facility Has Two Box Trucks That Are Used To Transport Used Oil And Hw. Both Trucks Have Department Of Transportation (Dot) Placards Displayed On The Sides Of The Trucks. Ck Keeps Copies Of The Permits, Notifications, Contingency Plan (In Case Of Emergency), And Manifests On The Truck. Also, The Trucks Are Properly Identified For Their Corresponding Wastes And Have Fire Extinguishers And Spill Kits Available. Record Review • Transport, Receiving And Shipping Records Were Available For Review At The Time Of Inspection. The Facility Has Maintained Records Since The Start Of Operation And Was Advised To Retain All Records Of Transportation And Training For Three Years. Notification History: Ck Initially Notified With The Department As A Hazardous Waste Transporter (Tra), Used Oil Transporter (Uot), Used Oil Filter Transporter (Uoft), Florida Universal Pharmaceutical Waste (Upw) Transporter, And For-Hire Universal Waste Mercury-Containing Lamps/Devices On 05/16/2019. The Facility Was Assigned The Epa Identification (Epaid) Number Flr000231258. The Facility Most Recently Notified As A Upw Transporter, Mercury-Containing Lamps Small Quantity Handler (Sqh), For-Hire Universal Waste Mercury-Containing Lamps/Devices Transporter And Transfer Facility, Hazardous Waste Tra And Transfer Facility, Uot And Used Oil Transfer Facility, And Uoft And Transfer Facility On 03/13/2024. Along With The Renotifications The Facility Had Attached Used Oil Annual Reports On Time To The Department. Inspection History: The Facility Was Previously Inspected By The Department On 05/20/2021 As A Tra, Uot, And Used Oil Transfer Facility And Was Found To Be In-Compliance At The Time Of Inspection. Safety Glasses And Steel-Toed Boots Were The Only Personal Protective Equipment (Ppe) Required To Enter The Facility At The Time Of The Inspection. The Representatives Stated That If The Forklift Was Currently In Operation, Then Personnel Would Additionally Be Required To Wear A Hard Hat And Potentially Protective Gloves. | Ck Is A 24/7 Emergency Hazardous Waste Disposal Service Transporter, Used Oil And Used Oil Filter Transporter And Transfer Facility, And A Universal Waste (Uw) Transporter For Industries Such As Aviation, Automotive, Manufacturing, Industrial, Dry Cleaners, Print Shops, And Universities. The Facility Doesn’T Generate Any Waste Of Their Own And Does Not Currently Act As A Transfer Facility Of Hazardous Waste. The Representative Informed Inspectors That The Facility Maintains The Transfer Facility Certification For When The Facility Intends To Start The 10-Day Storage, But Does Not Intend To Start Being A Transfer Facility Any Time Soon. The Facility Provides Transportation Services Such As Hazardous Waste Removal, Industrial Waste Disposal, Used Oil And Used Oil Filter, Waste-To-Energy, Uw Recycling, And Vacuum Truck. The Facility Has Three 24-Foot Box Trucks Used For Transporting Waste. Every Truck Has Department Of Transportation (Dot) Placards Displayed On The Sides Of The Trucks. Ck Keeps Copies Of The Permits, Notifications, Contingency Plan (In Case Of Emergency), And Manifests On The Truck. Also, The Trucks Are Properly Identified For Their Corresponding Wastes And Have Fire Extinguishers And Spill Kits Available.
